Informe jurídico sobre la Resolución 0811-2024/SPC-INDECOPI: El bullying: el deber de idoneidad en los servicios educativos

Resumen
El presente informe jurídico analiza la Resolución 0811-2024/SPC-INDECOPI,
emitida por la Sala Especializada en Protección al Consumidor de Indecopi, que
declaró fundada la denuncia presentada por la señora Emely María Chávez
Gallego en contra del Colegio Steve Jobs, por infracción al deber de idoneidad
del art.73 del Código de Protección y Defensa del Consumidor. El hecho
reportado el 6 de abril del 2022, en el que un compañero del hijo de la
denunciante tiró al tacho de basura su libreta de nota, constituye un caso de
bullying, que produce humillación y menoscabo en el bienestar emocional del
menor, por lo que no puede ser minimizado en cuanto a su gravedad. En relación
al deber de idoneidad, el Colegio no cumplió la garantía legal respecto a la
normativa sectorial de convivencia sin violencia en las escuelas, las cuales se
encuentran reguladas en la Ley N.º 29719 y su Reglamento, así como el
Protocolo del Lineamiento de Convivencia Escolar, la Prevención y la Atención
de la Violencia contra Niñas, Niños y Adolescentes. Consecuentemente, el
Colegio debió inscribir el hecho en el Libro de Registro de Incidencia, así como
reportarlo en el Portal SíSeve. Finalmente, tanto el Ministerio de Educación como
del Indecopi son competentes para calificar el hecho como infracción en base a
sus normativas de manera independiente.
This legal report analyzes Resolution 0811-2024/SPC-INDECOPI, issued by the Specialized Chamber for Consumer Protection of Indecopi, which declared founded the complaint filed by Ms. Emely María Chávez Gallego against the Steve Jobs School, for violating the duty of suitability of article 73 of the Consumer Protection and Defense Code. The incident reported on April 6, 2022, in which a classmate of the complainant's son threw his notebook in the trash, constitutes a case of bullying, which produces humiliation and damages the emotional well-being of the minor, so its seriousness cannot be minimized. Regarding the duty of appropriateness, the school failed to comply with the legal guarantee regarding the sectoral regulations for violence-free coexistence in schools, which are regulated by Law No. 29719 and its Regulations, as well as the Protocol for School Coexistence Guidelines, the Prevention and Response to Violence against Children and Adolescents. Consequently, the school was required to record the incident in the Incident Record Book and report it on the SíSeve Portal. Finally, both the Ministry of Education and Indecopi are competent to classify the incident as an infraction based on their regulations independently.
