Abstract
La Resolución 157-2019/SDC-INDECOPI marcó un hito en el mercado de GLP
al sancionar prácticas colusorias de fijación de precios y ordenar la
implementación de un Programa de Cumplimiento. Este programa, diseñado
para prevenir futuras infracciones, incluía auditorías anuales, capacitaciones
obligatorias y la designación de un oficial de cumplimiento. Si bien esta medida
carece de habilitación legal expresa, se sustenta en las facultades de INDECOPI
para restablecer la competencia y garantizar un mercado justo.
El análisis revela que el programa es innovador y está alineado con estándares
internacionales, pero enfrenta desafíos en su diseño. La falta de flexibilidad en
la selección de proveedores de capacitación y la ausencia de directrices claras
para las auditorías pueden limitar su efectividad. A pesar de estas deficiencias,
la duración de tres años y las exigencias impuestas son proporcionales al
impacto de la infracción.
Este caso subraya la importancia de equilibrar sanciones económicas con
medidas preventivas que transformen las estructuras internas de las empresas,
fomentando una cultura de cumplimiento sostenible. El éxito dependerá de un
monitoreo adecuado y ajustes estratégicos que refuercen su implementación.

This case underscores the need to balance economic sanctions with preventive measures that reshape companies' internal structures, fostering a sustainable compliance culture. Success will depend on proper monitoring and strategic adjustments to enhance its implementation.
