Informe jurídico sobre la Resolución 0723-2017/SDC-Indecopi: el caso del restaurante Central y los límites del control de barreras burocráticas

Abstract

El caso del restaurante Central, operado por Inversiones Viramar S.A.C., plantea un conflicto entre la libertad de empresa y la regulación municipal del uso del suelo. La Municipalidad Distrital de Miraflores le había negado la licencia de funcionamiento por estar en una zona residencial de densidad media (RDM), según las normas emitidas por la Municipalidad Metropolitana de Lima. Viramar denunció que esta prohibición constituía una barrera burocrática carente de razonabilidad. La Sala del Tribunal del Indecopi le dio la razón a Viramar, declarando que la disposición municipal no demostraba interés público, idoneidad, ni proporcionalidad. El caso refleja tensiones estructurales entre el control de barreras burocráticas y la planificación urbana y llama a repensar los límites del control administrativo en contextos de desarrollo territorial.

The case of the restaurant Central, operated by Inversiones Viramar S.A.C., raises a conflict between freedom of enterprise and municipal regulation of land use. The Municipality of Miraflores had denied the operating license on the grounds that the property was located in a medium-density residential zone (RDM), in accordance with regulations issued by the Metropolitan Municipality of Lima. Viramar claimed that this prohibition constituted an unreasonable bureaucratic barrier. The Indecopi Tribunal agreed with Viramar, declaring that the municipal provision lacked public interest, suitability, and proportionality.
