The case of the restaurant Central, operated by Inversiones Viramar S.A.C., raises a conflict between freedom of enterprise and municipal regulation of land use. The Municipality of Miraflores had denied the operating license on the grounds that the property was located in a medium-density residential zone (RDM), in accordance with regulations issued by the Metropolitan Municipality of Lima. Viramar claimed that this prohibition constituted an unreasonable bureaucratic barrier. The Indecopi Tribunal agreed with Viramar, declaring that the municipal provision lacked public interest, suitability, and proportionality. The case illustrates structural tensions between the control of bureaucratic barriers and urban planning, and invites a reconsideration of the limits of administrative control in the context of territorial development.
