Informe jurídico sobre la Casación N° 374 – 2015 – Caso Aurelio Pastor

Abstract

La investigación es el resultado del conocimiento sobre un caso controversial en torno a la imputación a un conocido abogado, político y que estuvo en diversas ocasiones como ministro de Estado, como es Aurelio Pastor Valdivieso. Desde un estudio cualitativo, basada en los informes, pronunciamientos, investigaciones. Así como el estudio del caso, que tiene como característica el abordaje del pronunciamiento de la Sala Suprema en la Casación Nº 3074-2015 En este polémico juicio, se observó que el político Aurelio Pastor Valdivieso fue sindicado como el autor del delito de tráfico de influencias en dos instancias; luego de una exhaustiva revisión de la máxima instancia del sistema judicial, como la Corte Suprema, se le absuelve. Indudablemente, este caso, que en su momento fue mediático, ha sido objeto de largo estudio y controversia, del cual ha sido parte de esta investigación, pero también hay que tener en cuenta, que este caso, que, si bien es cierto, debe analizarse dentro de la esfera estrictamente jurídica. Ahora en este ámbito, existió una influencia que no puede ser soslayada y que los peruanos hemos sido testigos a lo largo de los últimos años, como es el uso de procesos judicializados, que son instrumentos por los enemigos políticos, para realizar su vendetta política.
