Resumen
La sentencia N.º 00413-2022-PHC/TC resuelve una demanda de hábeas
corpus presentada por Luis Enrique Rodríguez Gutiérrez y Katya Karina Vilca
Jaramillo, quienes cuestionaron la legalidad de su detención ocurrida en enero
de 2021, llevada a cabo por efectivos de la Dipincri de San Juan de Lurigancho.
El Tribunal Constitucional, al analizar el caso, concluyó que dicha intervención
vulneró derechos fundamentales, ya que no existía flagrancia, orden judicial ni
elementos objetivos que justificaran una actitud sospechosa por parte de los
intervenidos.
El fallo establece criterios claros sobre el control de identidad por parte de la
Policía Nacional, señalando que este solo es válido cuando hay indicios
concretos de la comisión de un delito. Además, recalca que la ausencia del DNI
no puede ser motivo suficiente para trasladar automáticamente a una persona
a la comisaría, debiendo el agente policial facilitar que el intervenido pueda
identificarse por otros medios. En este caso, se evidenció que la negativa a
identificarse ocurrió después de la detención, lo que refuerza su carácter
arbitrario.
Con esta sentencia, el Tribunal fija posición sobre los límites legales del actuar
policial, reforzando la protección de los derechos individuales frente a posibles
abusos de autoridad durante intervenciones en la vía pública.
