Resumen
Los accidentes de tránsito son una de las razones más comunes de deceso en
el mundo, por ello, este tipo de seguro busca cubrir a las víctimas o a sus
beneficiarios frente a este tipo de siniestros. El SOAT cumple un rol primordial
en la protección de la vida e integridad de las personas, sin embargo, es
pertinente preguntarnos qué sucede cuando ocurre un accidente de tránsito
entre dos vehículos, uno asegurado y otro no asegurado, quienes serían los
obligados a cubrir los gastos en los que incurran las víctimas del vehículo no
asegurado o simplemente estas personas quedarían en una situación de
desprotección y abandono. Para abordar estas controversias se analizará la Ley
General de Transportes, el Reglamento del SOAT, así como diversas
resoluciones tanto en el ámbito administrativo como judicial. Finalmente, se
analizará cual es la interpretación adecuada que se realice a las normas que
permitirá que todas las víctimas de un accidente de tránsito entre dos vehículos,
uno asegurado y el otro no asegurado, puedan estar cubiertos por el seguro y
salvaguarden sus derechos fundamentales.
Traffic accidents are one of the most common causes of death worldwide, which is why this type of insurance aims to cover victims or their beneficiaries in the event of such incidents. SOAT plays a primary role in protecting people’s lives and well-being; however, it is pertinent to ask what happens when a traffic accident occurs between two vehicles—one insured and the other uninsured— who would be obligated to cover the expenses incurred by the victims in the uninsured vehicle, or would these individuals simply be left unprotected and abandoned? To address these controversies, the General Transportation Law, the SOAT Regulations, and various administrative and judicial resolutions will be analyzed. Finally, we will analyze which interpretation of the regulations is appropriate to ensure that all victims of a traffic accident between two vehicles— one insured and the other uninsured—are covered by insurance and have their fundamental rights safeguarded.
