Informe jurídico sobre la Sentencia del Pleno Jurisdiccional del Tribunal Constitucional 000-2007-PI/TC y 0010-2007-PI/TC (acumulados) - 29 de agosto de 2007

Abstract

El presente informe jurídico tiene como finalidad analizar la constitucionalidad de diversos artículos contenidos en las Leyes N.o 28875 y N.o 28925, los cuales regulan el funcionamiento del SINDCINR y modifican el régimen de competencias de la APCI, respectivamente. El análisis se centra en determinar si dichas disposiciones vulneran derechos fundamentales reconocidos por la Constitución, en particular en lo que respecta a las ONGs que canalizan la CTI. A través del estudio de la sentencia del TC recaída en los expedientes acumulados N.o 00009-2007-PI/TC y N.o 0010-2007-PI/TC, el informe aborda cuatro problemas jurídicos principales: i) si se ha vulnerado el derecho a la igualdad ante la ley; ii) si existe una afectación a la libertad de contratación; iii) si se ha comprometido el derecho a la vida privada y el derecho de asociación; y iv) si se ha transgredido el principio de tipicidad en el régimen de infracciones y sanciones administrativas que aplica la APCI. El estudio concluye que las disposiciones impugnadas no infringen los derechos ni principios constitucionales analizados, en la medida en que el régimen de supervisión y fiscalización que establece se aplica únicamente a aquellas entidades que, de manera voluntaria, acceden a beneficios públicos o privilegios fiscales. Asimismo, se determina que la regulación responde a fines legítimos como la transparencia, el buen uso de los recursos y la rendición de cuentas, y que las medidas adoptadas cumplen con los criterios de razonabilidad, necesidad y proporcionalidad exigidos en un Estado constitucional de derecho.

This legal report aims to analyze the constitutionality of various articles contained in Laws No. 28875 and No. 28925, which regulate the operation of the National Decentralized System of Non-Reimbursable International Cooperation (SINDCINR) and modify the regulatory framework of the Peruvian Agency for International Cooperation (APCI), respectively. The analysis focuses on determining whether these provisions infringe fundamental rights recognized by the Political Constitution of Peru, particularly with regard to NGOs that channel international technical cooperation (ITC). Through the study of the Constitutional Court’s ruling in the consolidated cases N° 0009-2007-PI/TC and N° 0010-2007-PI/TC, the report addresses four main legal issues: (i) whether the right to equality before the law has been violated; (ii) whether there is an infringement on the freedom of contract; (iii) whether the right to privacy and the right to association have been compromised; and (iv) whether the principle of typicity in the administrative sanctions regime applied by APCI has been transgressed. The study concludes that the contested provisions do not violate the constitutional rights or principles under analysis, insofar as the supervision and oversight regime they establish applies only to entities that voluntarily access public benefits or tax privileges. Furthermore, it is determined that the regulation pursues legitimate aims such as transparency, the proper use of resources, and accountability, and that the measures adopted meet the criteria of reasonableness, necessity, and proportionality required in a constitutional rule of law.
