Informe Jurídico sobre la sentencia 191/2022 del Expediente Nº 02653-2021-PA/TC “Caso Susel Paredes”

Abstract

El presente informe jurídico tiene como finalidad examinar la decisión del Tribunal Constitucional de declarar improcedente la demanda de amparo interpuesta por Susel Paredes Piqué y su esposa, Gracia María Aljovín de Losada. Las demandantes solicitaron al Registro Nacional de Identificación y Estado Civil (RENIEC) la inscripción de su matrimonio, celebrado válidamente en la ciudad de Miami, Estados Unidos. En ese contexto, se analiza si los argumentos expuestos por el Tribunal Constitucional resultan suficientes para justificar la improcedencia de la demanda y se evalúa si, desde una perspectiva constitucional, resulta válido reconocer e inscribir el matrimonio de las demandantes en el Perú. La investigación se sustentó en el análisis de fuentes doctrinales, el estudio de la jurisprudencia emitida por el Tribunal Constitucional en materia de familia y matrimonio, y la evaluación de las disposiciones normativas vigentes. A modo de conclusión, se sostiene que resulta imprescindible reflexionar sobre las repercusiones del fallo en relación con los principios de igualdad y no discriminación. La decisión de declarar improcedente la demanda y no reconocer el matrimonio celebrado por las demandantes, basada en argumentos que eluden el análisis profundo de la igualdad en el acceso al matrimonio, constituye una restricción injustificada de sus derechos fundamentales. Esta negativa perpetúa un trato desigual hacia las parejas del mismo sexo y contradice el mandato constitucional y convencional de garantizar una protección igualitaria y sin discriminación a todas las personas.

The present legal report aims to examine the decision of the Constitutional Court to dismiss, on grounds of inadmissibility, the amparo lawsuit filed by Susel Paredes Piqué and her spouse, Gracia María Aljovín de Losada. The plaintiffs requested that the National Registry of Identification and Civil Status (RENIEC) register their marriage, which was validly celebrated in Miami, United States. In this context, the report analyzes whether the arguments presented by the Constitutional Court are sufficient to justify the inadmissibility of the claim and assesses whether, from a constitutional perspective, it is legally valid to recognize and register the plaintiffs' marriage in Peru. The research was based on the analysis of doctrinal sources, the study of case law issued by the Constitutional Court regarding family and marriage matters, and the evaluation of the current legal provisions. In conclusion, it is argued that it is essential to reflect on the repercussions of the ruling in relation to the principles of equality and non-discrimination. The decision to declare the claim inadmissible and to refuse recognition of the marriage celebrated by the plaintiffs, based on arguments that avoid a thorough analysis of equality in access to marriage, constitutes an unjustified restriction of their fundamental rights. This refusal perpetuates unequal treatment toward same-sex couples and contradicts both the constitutional and conventional mandates to guarantee equal and nondiscriminatory protection for all individuals.
