Abstract
En el presente informe abordamos el Exp. No. 00048-2021/CEB, en el cual se
analiza como cuestión principal la potencial imposición de barreras burocráticas
ilegales y/o carentes de razonabilidad por parte de la Municipalidad Distrital de
Miraflores a través de las Ordenanzas No. 287-MM y 554-MM, en las que se
dispone, entre otras cosas, la prohibición de despliegue de infraestructura aérea
de telecomunicaciones.
Para resolver tal cuestión, recurrimos a diversas instituciones del derecho
administrativo, con miras a determinar qué competencias han sido atribuidas por
nuestro ordenamiento jurídico a las municipalidades para emitir disposiciones
normativas en materia de telecomunicaciones, además de cómo se relaciona la
autonomía normativa edilicia con las disposiciones reservadas para la regulación
del gobierno central.
Finalmente, abordamos la importancia de adoptar una postura garantista de cara
a facilitar a los administrados el acceder al análisis de razonabilidad en el marco
de la metodología de análisis de barreras burocráticas del Indecopi. Ello para
que no se vea limitada su posibilidad de cuestionar la pertinencia de las normas
impuestas, ni la del Indecopi de hacer un control regulatorio posterior.
A través ello, concluimos que las medidas cuestionadas importan una barrera
burocrática carente de razonabilidad al no haberse acreditado que se haya
valorado adecuadamente el impacto en los administrados.
In this report, we address Case 00048-2021/CEB, in which the main issue analyzed is the potential imposition of illegal and/or unreasonable bureaucratic barriers by the Municipalidad Distrital de Miraflores through Ordinances No. 287- MM and 554-MM, which, among other things, forbidden the deployment of aerial telecommunications infrastructure. To resolver this topic, we refer to various administrative law institutions to determine which competencies have been attributed by our legal system to municipalities to issue normative provisions in the field of telecommunications, as well as how municipal regulatory autonomy relates to provisions reserved for central government regulation. Finally, we address the importance of adopting a guarantee-based approach to facilitate citizens’ access to the reasonableness analysis within the framework of Indecopi’s bureaucratic barriers analysis methodology. This is to ensure that their ability to question the relevance of the imposed regulations is not limited, nor is Indecopi’s ability to conduct subsequent regulatory control. Through this, we conclude that the challenged measures constitute an unreasonable bureaucratic barrier, as it has not been demonstrated that the impact on citizens has been adequately assessed.
