Resumen
Este expediente fue seleccionado por la relevancia de los problemas jurídicos que
plantea, abarcando las áreas del Derecho Procesal Penal y el Derecho Probatorio. El
caso examina las irregularidades y vulneraciones al debido proceso y a la presunción
de inocencia en el proceso penal seguido contra Rider García, quien fue condenado por
la 4° Sala Penal de la Corte Superior de Justicia por el delito de robo agravado. La
sentencia se basó en una valoración deficiente de la declaración de la testigo-víctima y
estuvo marcada por reiteradas violaciones a los derechos fundamentales del imputado,
especialmente al derecho a la libertad personal.
Este informe analiza los principales problemas jurídicos identificados en el caso. En
primer lugar, se evaluará si la detención en flagrancia realizada por la policía fue
arbitraria. En segundo lugar, se abordará el mandato de detención judicial emitido por
el Juez Penal, examinando si este cumplió con los requisitos constitucionales de
motivación y proporcionalidad, considerando la naturaleza cautelar de la medida.
Finalmente, se analizará la valoración probatoria efectuada por la 4° Sala Penal al emitir
su sentencia condenatoria.
This case file was selected due to the relevance of the legal issues it presents, encompassing the areas of Criminal Procedural Law and Evidence Law. The case examines irregularities and violations of due process and the presumption of innocence in the criminal proceedings against Rider García, who was convicted by the 4th Criminal Chamber of the Superior Court of Justice for the crime of aggravated robbery. The conviction was based on a deficient assessment of the testimony provided by the witness-victim and was marked by repeated violations of the defendant's fundamental rights, particularly the right to personal liberty. This report analyzes the main legal issues identified in the case. First, it will evaluate whether the flagrante delicto arrest carried out by the police was arbitrary. Second, it will address the judicial detention order issued by the Criminal Judge, examining whether it met constitutional requirements for justification and proportionality, considering the precautionary nature of the measure. Finally, it will analyze the evidentiary assessment conducted by the 4th Criminal Chamber in issuing its conviction
