Informe sobre la Sentencia del Tribunal Constitucional EXP N° 02695-2021-PA/TC

Abstract

Este informe analiza el expediente N.o 02695-2021-PA/TC, en el que Andrea Alejandra Canales Caballero interpone una demanda de amparo contra RENIEC y el padre de su hija, debido a la inscripción de la niña con el apellido paterno en primer lugar, sin acuerdo previo entre ambos progenitores. La práctica de RENIEC de priorizar automáticamente el apellido del padre es cuestionada por su posible vulneración de derechos fundamentales. Se examina si esta práctica afecta el derecho a la identidad, el interés superior del niño, así como los derechos a la igualdad, la no discriminación por género y a la pluralidad de modelos familiares reconocidos a nivel constitucional. El informe concluye que el criterio adoptado por RENIEC vulnera derechos fundamentales al imponer de forma automática un orden de apellidos sin el consentimiento de ambos progenitores. Se recomienda revisar esta práctica para garantizar un trato equitativo y respetuoso de los derechos de la menor y de sus padres.

This report examines file N.º 02695-2021-PA/TC, in which Andrea Alejandra Canales Caballero files a constitutional complaint against RENIEC and the father of her daughter, due to the registration of the minor with the paternal surname first, without prior agreement between both parents.
