reconocidos a nivel constitucional.
This report examines file N.º 02695-2021-PA/TC, in which Andrea Alejandra Canales Caballero files a constitutional complaint against RENIEC and the father of her daughter, due to the registration of the minor with the paternal surname first, without prior agreement between both parents. RENIEC's practice of automatically prioritizing the father's surname is questioned for its potential violation of fundamental rights. The report examines whether this practice affects the right to identity, the best interest of the child, as well as the rights to equality, nondiscrimination based on gender, and the plurality of family models recognized at the constitutional level The report concludes that RENIEC's criterion infringes upon fundamental rights by automatically imposing a surname order without the consent of both parents. It is recommended that this practice be revised to ensure equitable treatment and respect for the rights of both the minor and the parents.
