Informe Jurídico sobre la Resolución N° 07 recaída en el Expediente N° 00581-2019-0-1817-SP-CO-02

Abstract

El presente informe jurídico tiene por objeto analizar la Resolución N° 07 recaída en el Expediente N° 00581-2019-0-1817-SP-CO-02 mediante la cual se anuló el Laudo Arbitral del Expediente N°0265-2017-CCL en el extremo referido a la cuantificación de mayores gastos generales. En ese marco, se analizará el deber de motivación de los Laudos Arbitrales como una garantía esencial del debido proceso, así como los requisitos normativos aplicables para el otorgamiento de ampliaciones de plazo en el marco de Contratos de Obra Pública bajo la Ley de Contrataciones del Estado. Es así que, del análisis efectuado, se podrá concluir si la Segunda Sala Civil Subespecialidad Comercial de la Corte Superior de Justicia de Lima identificó correctamente los vicios de motivación contenidos en el referido Laudo Arbitral y si la decisión tomada por el Colegiado del Primer Laudo Arbitral se encontraba debidamente fundamentada en el marco jurídico aplicable al caso.

The purpose of this legal report is to analyze the Resolution N° 07 issued in Case N° 00581-2019-0-1817-SP-CO-02, whereby the Arbitral Award of Case N° 0265- 2017-CCL was annulled, specifically in the point referring to the quantification of higher overhead costs. Within this framework, the duty of motivation of the Arbitral Awards will be analyzed as an essential guarantee of due process, as well as the applicable regulatory requirements for the granting of term extensions in the framework of Public Works Contracts. Therefore, from the analysis carried out, will be possible to conclude whether Segunda Sala Civil Subespecialidad Comercial de la Corte Superior de Justicia de Lima correctly identified the defects in the reasoning contained in the referred Arbitral Award and whether the decision taken by the Court was duly grounded in the legal framework applicable to the case.
