Resumen
El presente informe jurídico analiza la Apelación N°12-2019 Sala Penal Especial,
la cual desarrolla un caso de tráfico de influencias agravado en el que estuvieron
involucrados Luis Alberto Vásquez Silva, juez superior y miembro del Consejo
Ejecutivo del Poder Judicial, y Corina de la Cruz Yupanqui, alcaldesa de la
Municipalidad de Tocache. Esta sentencia de segunda instancia permite realizar
un análisis respecto del rol del tercero interesado en la configuración del delito
de tráfico de influencias y su correspondiente responsabilidad penal, así como
las figuras de participación de los artículos 24 y 25 del Código Penal bajo las
cuales podría responder (instigación y complicidad).
Asimismo, se analiza también si la tercera interesada, Corina de la Cruz
Yupanqui, podía ostentar la condición de agraviada en el proceso, para lo cual,
previamente, se hace necesario analizar las diferentes posturas referidas al bien
jurídico protegido por la tipificación del delito mencionado. De igual forma, se
evalúan cuáles habrían sido los efectos procesales de incluir a Corina de la Cruz
como coimputada y si la Sala hizo una adecuada motivación respecto de la
apelación referida a la prueba pericial. Finalmente, se arriba a la conclusión de
que, en el presente caso, Corina de la Cruz sí tuvo responsabilidad penal por
cuanto su conducta se adecúa en la instigación.
This legal report analyzes the Appeal N°12-2019 Special Criminal Chamber, which develops a case of aggravated influence peddling in which Luis Alberto Vásquez Silva, superior judge and member of te Executive Council of the Judiciary, and Corina de la Cruz Yupanqui, mayor of the District Municipality of Tocache, were involved. This second instance sentence allows an analysis of the role of the interested third party in the comission of influence peddling and its corresponding criminal responsibility, as well as the participation figures of articles 24 and 25 of Criminal Code under which he could respond (instigation and complicity). Likewise, it is also analyzed whether the third interested party, Corina de la Cruz Yupanqui, could be an aggrieved party in the process, for which, previously, it is necessary to analyze the different positions referred to the legally protected right by the typification of the mentioned offense. Furthermore, the procedural effects of including Corina de la Cruz as a co-defendant and whether the Court made an adequate evaluation of the expert evidence are also evaluated. Finally, it is concluded that, in the present case, Corina de la Cruz did have criminal responsibility since her conduct is in line with instigation.
