Informe jurídico sobre la Resolución Nº 9 del Expediente Nº 000581-2023-0-1817-SP-CO-02

Abstract

El presente informe tiene como objeto analizar la Resolución N°9 emitida por la Segunda Sala Civil Subespecialidad Comercial de la Corte Superior de Justicia de Lima, recaída en el Expediente N° 000581-2023-0-1817-SP-CO-02. En dicha resolución, la Sala resuelve el recurso de anulación de laudo arbitral interpuesto por OSITRAN contra el laudo arbitral emitido en el marco del arbitraje entre JNR Consultores S.A. y OSITRAN, cuyo conflicto tiene origen en la imposición de penalidades contractuales a JNR por presuntos incumplimientos, las cuales fueron declaradas como nulas por el Tribunal Arbitral en razón de su caducidad. La finalidad del informe es realizar un análisis jurídico respecto a si correspondía que la Sala declare fundadas las pretensiones de OSITRAN, a partir de la evaluación del carácter arbitrable de la materia y el alcance de la potestad del Tribunal Arbitral para aplicar de oficio figuras jurídicas como la caducidad

The purpose of this report is to analyze Resolution N°9 issued by the Second Civil Chamber of the Lima Superior Court of Justice in Case N° 000581-2023-0- 1817-SP-CO-02. In said resolution, it was decided to resolve the appeal for annulment of the arbitration award filed by OSITRAN against the arbitration award issued in the arbitration between JNR Consultores S.A. and OSITRAN, whose conflict has its origin in the imposition of contractual penalties to JNR for alleged non-compliance, which were declared null and void by the Arbitration Court due to their expiration. The purpose of the report is to carry out a legal analysis as to whether the Chamber should declare OSITRAN's claims to be well founded, based on the evaluation of the arbitrable nature of the matter and the scope of the Arbitral Tribunal's power to apply ex officio legal concepts such as forfeiture.
