Resumen
En el presente informe jurídico se analiza la Resolución del Tribunal Fiscal No.
4154-9-2024, la que se abarca la deducibilidad de la pérdida por diferencia en
cambio generada por la re-expresión en moneda nacional de los saldos
generados por el Impuesto a la Renta Anual (IR), los pagos a cuenta del
Impuestos a la Renta (PAC IR) e Impuesto General a las Ventas (IGV), siendo
que el recurrente es una empresa que lleva su contabilidad en dólares
americanos.
En estricto, se aborda la problemática jurídica si debe ser computable para la
renta neta imponible la diferencia en cambio (sea ganancia o pérdida) generada
por la expresión en moneda extranjera, los saldos en moneda nacional de las
cuentas contables vinculadas al IR y al IGV, en virtud del primer párrafo del
artículo 61 de la Ley del Impuesto a la Renta, entre otras normas pertinentes.
Para realizar el análisis de la presente resolución, se utilizará la normativa
pertinente como el Código Tributario, la LIR, el Decreto Supremo No. 151-2002-
EF, jurisprudencia de la Corte Suprema y el TF, así como bibliografía
especializada en el tema.
En ese sentido, el presente informe cuestiona el criterio optado por el TF, siendo
que no se ha interpretado de manera correcta el primer párrafo del artículo 61 de
la LIR, toda vez que el IR, los PAC IR y el IGV no constituyen operaciones
vinculadas a la generación de renta gravada o el mantenimiento de la fuente
productora.
In this legal report, the Resolution of the Tax Court No. 4154-9-2024 is analyzed, which addresses the deductibility of the loss due to exchange rate differences generated by the re-expression in national currency of the balances generated by the Annual Income Tax (IT), the advance payments of the Income Tax (AP IT), and the Value Added Tax (VAT), considering that the appellant is a company that keeps its accounting in US dollars. Strictly speaking, the legal issue addressed is whether the exchange rate difference (whether gain or loss) generated by the expression in foreign currency of the balances in national currency of the accounting accounts linked to the IR and IGV should be computable for the taxable net income, by virtue of the first paragraph of Article 61 of the Income Tax Law, among other relevant regulations. To conduct the analysis of this resolution, the relevant regulations such as the Tax Code, the LIR, Supreme Decree No. 151-2002-EF, jurisprudence from the Supreme Court and the Tax Court, as well as specialized literature on the subject will be used. In this sense, this report questions the criterion adopted by the Tax Court, as the first paragraph of Article 61 of the LIR has not been correctly interpreted, since the IR, PAC IR, and IGV do not constitute operations linked to the generation of taxable income or the maintenance of the producing source.
