La viabilidad jurídica de la Participación en el Incremento del Valor del Suelo como herramienta de gestión del suelo a la Luz de la Ley N° 31313, Ley de Desarrollo Urbano Sostenible: oportunidades y desafíos en el contexto peruano

Abstract

La presente investigación se propone analizar la viabilidad jurídica de la “Participación en el Incremento del Valor del Suelo” como herramienta de gestión del suelo en Perú, conforme a la Ley N° 31313 de Desarrollo Urbano Sostenible. Se estudia el concepto de propiedad predial y su evolución histórica, destacando la función social del suelo y su revalorización por intervenciones públicas. A través de un análisis de derecho comparado, se revisan experiencias en España, Ecuador y otros países para evaluar su aplicabilidad en el contexto peruano. Con base a ello y la doctrina especializada, se busca determinar en qué consiste el concepto aplicable en el Perú y precisar su fundamento técnico, legal y ético asociado al principio de impedir el enriquecimiento sin causa. Finalmente, se argumenta que este mecanismo no constituye un tributo ni es confiscatorio, sino que busca redistribuir equitativamente el valor adicional del suelo generado por la sociedad. Se concluye que su implementación requiere claridad normativa, metodologías estandarizadas y difusión entre actores clave para garantizar su aceptación y eficacia.

This research aims to analyze the legal feasibility of the “Participation in the Increase of Land Value” as a land management tool in Peru, in accordance with Law No. 31313 on Sustainable Urban Development. The study examines the concept of property ownership and its historical evolution, highlighting the social function of land and its revaluation through public interventions. Through a comparative law analysis, experiences in Spain, Ecuador, and other countries are reviewed to assess their applicability in the Peruvian context. Based on this analysis and specialized legal doctrine, the research seeks to define the applicable concept in Peru and establish its technical, legal, and ethical foundation associated with the principle of preventing unjust enrichment. Finally, it is argued that this mechanism is neither a tax nor confiscatory but rather aims to equitably redistribute the additional land value generated by society. The study concludes that its implementation requires regulatory clarity, standardized methodologies, and dissemination among key stakeholders to ensure its acceptance and effectiveness.
