Resumen
El presente trabajo de investigación aborda el rol de la regulación en el proceso de
innovación en el sector telecomunicaciones peruano, tomando como caso de estudio el
sandbox regulatorio recientemente aprobado en el país. Así, en el marco teórico, se
analiza la relación entre la regulación y la innovación, cómo los reguladores han
incorporado mecanismos basados en evidencia que evalúan proyectos innovadores,
dentro de los cuales destaca el sandbox regulatorio que permite probar productos,
servicios o modelos de negocio, bajo la supervisión del regulador quien otorga, de manera
temporal, exenciones o flexibilizaciones regulatorias.
A partir de la revisión de experiencias desarrolladas en otros países, el estudio identifica
y compara elementos comunes tales como gobernanza, temporalidad, criterios de
elegibilidad y opciones de salida, para luego evaluar el diseño del modelo peruano,
destacando sus fortalezas y aspectos de mejora en materia de gobernanza y calidad
regulatoria.
Los resultados muestran que, si bien la implementación del sandbox regulatorio
constituye un paso importante hacia un marco normativo más flexible y adaptativo que
fomente la innovación en el sector telecomunicaciones peruano, su gobernanza debe estar
a cargo de una entidad con alta especialización técnica, de modo que se asegure un diseño
institucional sólido. Finalmente, se plantean recomendaciones orientadas a la
implementación de esta herramienta por el Osiptel como ente regulador especializado, así
como alinear la experiencia nacional con las buenas prácticas de la OCDE.
This research paper addresses the role of regulation in the innovation process within the Peruvian telecommunications sector, using the recently approved regulatory sandbox in the country as a case study. The theoretical framework analyzes the relationship between regulation and innovation, examining how regulators have incorporated evidence-based mechanisms to evaluate innovative projects. Among these mechanisms, the regulatory sandbox stands out, allowing for the testing of products, services, or business models under the supervision of the regulator, who grants temporary regulatory exemptions or flexibilities. Based on a review of experiences in other countries, the study identifies and compares common elements such as governance, timeframes, eligibility criteria, and exit options. It then evaluates the design of the Peruvian model, highlighting its strengths and areas for improvement in governance and regulatory quality. The results show that, while the implementation of the regulatory sandbox is an important step toward a more flexible and adaptive regulatory framework that fosters innovation in the Peruvian telecommunications sector, its governance must be entrusted to an entity with a high level of technical expertise to ensure a robust institutional design. Finally, recommendations are made for the implementation of this tool by Osiptel, the specialized regulatory body, and for aligning national experience with OECD best practices.
