Abstract
En la presente investigación analizamos la libertad sexual como bien jurídico susceptible
de ser delegado por su titular en terceras personas, desde el contexto de prostitución libre.
En esa línea, cuestionamos la tradicional concepción del referido bien jurídico, conforme a
la cual es el titular del mismo quien debe decidir sobre todos los factores que concurren en
el acto sexual. Y, en su lugar, postulamos que el titular de un bien jurídico individual tiene
plena capacidad de disposición sobre el mismo, hasta el extremo de su delegación. En un
contexto de prostitución libre, el titular del bien jurídico libertad sexual podrá delegar en
terceros la capacidad de decisión sobre el mismo. Asumiendo dichos terceros obligaciones
frente a quien se prostituye, de cuyo incumplimiento se derivan responsabilidades penales.
This paper analyzes whether sexual freedom could be delegated to third parties, in the context of non-coactive prostitution. The author questions traditional conceptions existing in Peruvian criminal law to determinate the extend of sexual freedom, according to which only one person could determinate the extent of his own sexual activities. Instead, the author considers that this faculty could be delegate in third parties, who could decide on all the factors and circumstances involved in the sexual activity of other persons. This postulate changes the traditional conception in Peruvian criminal law and attributes obligation to the third parties in a context of non-coactive prostitution, non-compliance of which gives rise to criminal liability.
