Informe jurídico sobre la Resolución Nº 2321-2011/SC2- INDECOPI

Abstract

El presente informe jurídico, resuelto mediante la Resolución Nº 2321-2011/SC2- INDECOPI de la Sala de Defensa de la Competencia Nº2, nos permite abordar la práctica de la compensación bancaria sobre cuentas remunerativas desde el marco normativo del derecho financiero y constitucional. En ese sentido, se busca analizar si el supuesto planteado por el consumidor — según el cual los cargos efectuados sobre su cuenta sueldo vulneraban la inembargabilidad de las remuneraciones— puede calificar o no como una práctica legítima dentro del sistema financiero. Se sustentará que, la compensación constituye un mecanismo válido y necesario para preservar la estabilidad del sistema, pues una vez depositadas en el sistema bancario las remuneraciones pierden su carácter alimentario y se convierten en depósitos de ahorro sujetos a las reglas de la Ley Nº 26702. Debido a ello, la restricción impuesta por la jurisprudencia administrativa y judicial genera inseguridad jurídica, ya que se limita de forma injustificada la autonomía contractual y la función constitucional de protección del ahorro.

This legal report, resolved through Resolution No. 2321-2011/SC2-INDECOPI of the Second Chamber for Competition Defense, allows us to examine the practice of bank compensation (netting) applied to salary accounts within the regulatory framework of financial and constitutional law. In this regard, the analysis seeks to determine whether the claim raised by the consumer—that the charges made to his salary account violated the protection of wages of his salary—could be considered a legitimate practice within the financial system. It will be argued that compensation constitutes a valid and necessary mechanism to preserve the stability of the system, since once the salary is deposited into the banking system, they lose their alimentary character and become savings deposits subject to the rules of Law No. 26702. Consequently, the restriction imposed by administrative and judicial jurisprudence generates legal uncertainty, as it unjustifiably limits contractual autonomy and the constitutional function of protecting savings.
