Informe jurídico sobre Resolución N° 0243-2018/SPCINDECOPI del Expediente N° 147-2017/CC2

Abstract

Este informe legal aborda la posible existencia de una cláusula abusiva en la venta de entradas al cine de parte de Cinemark, según lo establecido en la Resolución N.º 0243-2018/SPC-INDECOPI. La cláusula en cuestión prohibía el ingreso a las salas de cine con alimentos comprados fuera del local, lo que, presuntamente, podría representar una afectación al derecho de los consumidores a elegir libremente. En ese contexto, el presente informe tiene como objetivo determinar si la política comercial implementada por Cinemark vulnera efectivamente dicho derecho y, en consecuencia, si se configuran los elementos que caracterizan una cláusula abusiva. En tal sentido, luego del análisis realizado, se concluye que no se configuró una vulneración al derecho de autodeterminación del consumidor en cuanto a la libertad de elección sobre los bienes que desea adquirir y consumir, toda vez que dicha limitación impuesta por Cinemark se encontraría sustentada en la lógica comercial legítimamente adoptada por la empresa.
