Abstract
En el presente trabajo de investigación, se expone cómo varían los límites del ejercicio
del derecho fundamental a la objeción de conciencia, de acuerdo con el concepto de
justicia que el Derecho busque maximizar. En esa dirección, empleamos la teoría de los
derechos fundamentales para reconocer a los elementos del derecho fundamental a la
objeción de conciencia tanto en la Constitución, doctrina y jurisprudencia de Perú, como
en las de España y Colombia. Al respecto, estos elementos son la autoconciencia y un
contenido moral. En este contenido moral incide la Justicia.
Se revela pues la variación de límites de un derecho fundamental en base al modelo de
Justicia que asuma el Derecho. Los límites del ejercicio del derecho bajo estudio no son
los mismos cuando el Derecho maximiza una justicia liberal libertaria que cuando
maximiza una justicia liberal igualitaria.
Se avizora, entonces, imprecisión en las teorías de la argumentación jurídica sobre los
límites del ejercicio del derecho fundamental bajo estudio, en el modelo del Estado
Constitucional; permitiendo salvar la defensa de Dios como un infinito, indeterminable e
ilimitado, en el que navegan la conciencia y el Derecho. Al respecto, estas reflexiones
constituyen la última parte de este trabajo, a la que hemos llamado la objeción de Dios,
el derecho a objetarlo todo por una cuestión de Justicia.
Este trabajo así se erige como un monumento a lo inconmensurable y a lo invisible,
herencia de nuestros ancestros y parte de la naturaleza del hombre. Además de los
recursos bibliográficos, con ayuda del arte pictórico y arquitectónico de las culturas
antiguas del mundo, hemos podido contemplar la Teoría General del Derecho y el
derecho a la objeción de conciencia desde lo profundo del abismo.
In this article, it has been exposed how the limits of the exercise of the fundamental right to conscientious objection vary, according to the concept of justice that the Law seeks to maximize. For these purposes, we have started from the theory of fundamental rights and the description of that right according to the Constitution, doctrine and jurisprudence of Peru, Spain and Colombia. In this way, it was possible to identify self-awareness and some moral content as main elements of the right under examination. It is in that moral content where Justice appears. Therefore, a variation of the limits of a fundamental right, depending on the model of Justice that the Law assumes, has been exposed. Basically, the limits of the exercise of the right to conscientious objection are not the same when the Law maximizes an ideal of libertarian liberal justice as when it maximizes a model of egalitarian liberal justice. This demonstration warns of imprecision in theories about the limits of the exercise of the fundamental right under study, within the model of the Constitutional State; which allows us to postulate the defense of God as an infinite, indeterminable and unlimited being, in which conscience and Law navigate. These reflections constitute the last part of this research and it has been denominated God’s objection, the right to oppose everything for a matter of Justice. This work is a monument to the immeasurable and the invisible, the inheritance of our ancestors and the nature of humanity. Besides texts, with the help of the pictorial and architectural art of the ancient world, we have been able to contemplate the General Theory of Law and the right to conscientious objection from the deep abyss.
