Abstract
La tesis en cuestión tiene por objeto contribuir a identificar las acciones de
aprendizaje institucionalizadas en tres pilares (político, económico y social) que han
permitido y seguirán permitiendo continuar con la profundización de la relación
bilateral Chile – Perú, post fallo de la Corte Internacional de Justicia-CIJ de La Haya.
En este sentido, la tesis parte de un hito relevante en el acontecer de la relación de
ambos países, dicho hito es el Fallo de la CIJ de La Haya, el cual es leído por ambas
cancillerías como el último capítulo pendiente de esta historia bilateral.
Es a partir del Fallo de la CIJ de La Haya que el documento identifica pilares
en el ámbito político, económico y social, los cuales son aterrizados en acciones
institucionalizadas que se traducen en lecciones aprendidas que involucran no solo
la voluntad política al más alto nivel de las repúblicas de Chile y Perú, sino que
además logran ser profundizados de manera transversal en ambas sociedades
buscando elementos de anclaje que hoy forman parte de la agenda
institucionalizada de ambos Estados, caso del actuar del Consejo Empresarial Chile
Perú, el reconocimiento de las manifestaciones de fe de ambos pueblos, Comités
de Integración Fronteriza entre la macro zona norte de Chile y sur del Perú. En
resumen, acciones que buscan la integración, esta vez más allá de lo económico y
comercial.
El documento incluye un análisis de las posturas que tenían ambas naciones
antes de que la CIJ de La Haya resolviera la controversia existente, evidenciando
así, cómo cada nación interviniente recurre al conflicto, reconociendo enfoques de
análisis divergentes; ejemplo, toda vez que ambas naciones mantenían una
controversia que era considerada un asunto pendiente en la relación bilateral, se
decidió colocar la referida controversia en un tribunal internacional de manera que
dicho tribunal, de acuerdo al derecho y jurisprudencia internacional resolviera,
evitando así desgastar y friccionar la referida relación. Además de ello, evita análisis
de posturas unilaterales, por el contrario, los análisis efectuados fueron en razón de
la pretensión del otro, de manera de poder comprender, desde otro ángulo, la razón
de su postura e incorporando como interés común que los resultados alcanzados
sean mutuamente ventajosos.

De igual forma, esta investigación tiene como pretensión constituirse en un
documento referencial para los agentes diplomáticos peruanos en Chile y chilenos
en Perú, en cuanto éstos y sus Estados continúen manteniendo el interés, acorde a
la política exterior de ambos países, de seguir profundizando las acciones
identificadas en el presente trabajo.
The purpose of the thesis in question is to help identify the institutionalized learning actions in three pillars (political, economic and social) that have allowed and will continue to allow the deepening of the Chile-Peru bilateral relationship, after the decision of the International Court of Justice. In this sense, the thesis starts from a relevant milestone in the events of the relationship between both countries, said milestone is the ICJ Decision of The Hague, which is read by both foreign ministries as the last pending chapter of this bilateral history. It is from the Ruling of the ICJ of The Hague that the document identifies pillars in the political, economic and social sphere, which are landed in institutionalized actions that translate into lessons learned that involve not only the political will at the highest level of the republics of Chile and Peru, but also manage to be deepened transversally in both societies looking for anchoring elements that today are part of the institutionalized agenda of both States, case of the action of the Chile Peru Business Council, the recognition of the manifestations of faith of both peoples, Border Integration Committees between the northern macro zone of Chile and southern Peru. In short, actions that seek integration, this time beyond the economic and commercial. The document includes an analysis of the positions that both nations had before the ICJ of The Hague resolved the existing controversy, thus showing how each intervening nation resorts to conflict, recognizing divergent analysis approaches; For example, since both nations had a controversy that was considered a pending issue in the bilateral relationship, it was decided to place the aforementioned controversy in an international court so that said court, in accordance with international law and jurisprudence, would resolve, thus avoiding wear and tear and friction the aforementioned relationship. In addition to this, it avoids analysis of unilateral positions, on the contrary, the analyzes carried out were due to the claim of the other, in order to understand, from another angle, the reason for their position and incorporating as a common interest that the results achieved are mutually advantageous. In the same way, this investigation aims to become a reference document for Peruvian diplomatic agents in Chile and Chileans in Peru, as long as they and their States continue to maintain the interest, in accordance with the foreign policy of both countries, to continue deepening the actions identified in the present work.
