Abstract
El informe a desarrollar tiene como propósito analizar la Resolución N.º 3703-2022-
SUNARP-TR, mediante la cual se pretendía inscribir en el registro público cláusulas
que restringían determinadas facultades de la propiedad. De acuerdo a la mencionada
resolución, se concluye que es viable inscribir en el registro público las cláusulas que
limiten la facultad de uso y disfrute de la propiedad; no obstante, esto no ocurre
respecto a las cláusulas que prohíben la disposición de los bienes. El fundamento a
la prohibición a estas cláusulas radica en la regulación contenida en el Código Civil
peruano. El presente caso permite analizar el tratamiento y regulación de esta
prohibición en el ordenamiento jurídico peruano y en la legislación comparada. Por
otro lado, mediante el presente informe jurídico, se pretende cuestionar la calidad de
motivación del Tribunal Registral respecto al análisis de estos casos.
The purpose of this academic paper is to analyze Resolution No. 3703-2022- SUNARP-TR, through which it was intended to register clauses in the public registry that restricted certain powers of the property. According to the resolution, it is concluded that it is feasible to register in the public registry the clauses that limit the power of use and enjoyment of the property; However, this does not occur with respect to clauses that prohibit the disposal of assets. The basis for the prohibition of these clauses lies in the regulation in the Peruvian Civil Code. This case allows us to analyze the treatment and regulation of this prohibition in the Peruvian legal system and in comparative legislation. Likewise, through this legal report, it is intended to question the quality of motivation of the Registry Court regarding the analysis of these cases.
