Informe jurídico sobre la sentencia de la Corte Interamericana de Derechos Humanos sobre el caso Vicky Hernández vs. Honduras

Abstract

El presente informe jurídico analiza la responsabilidad internacional de Honduras en el caso de la muerte de la activista trans Vicky Hernández, abordado por la Corte Interamericana de Derechos Humanos (Corte IDH) en su sentencia expedida en el año 2021. La referida sentencia marcó un precedente histórico al determinar por primera vez en el ámbito regional, la responsabilidad de un Estado por actos de violencia letal contra una persona trans, desde una clara perspectiva de identidad de género. El objetivo del informe estará centrado en establecer si en el marco de la muerte de Hernández y las consecuentes actuaciones judiciales que se llevaron a cabo con el fin de señalar responsabilidades configuraron una vulneración a los derechos a la vida e integridad personal, a las garantías judiciales y protección judicial, al reconocimiento a la personalidad jurídica, vida privada y libertad de expresión. Asimismo, se buscará incidir en el trasfondo discriminatorio y de violencia por prejuicio que se registró en la actuación estatal para dicho caso. El informe concluye que la muerte de Hernández se dio en un contexto de violencia generalizada contra personas trans en Honduras y que dicho Estado incurrió en responsabilidad internacional al no prevenir e investigar su deceso, vulnerando los derechos mencionados. Asimismo, se concluye que la muerte de Vicky Hernández estuvo motivada en prejuicios sustentados en su identidad de género. De igual manera, la respuesta estatal resultó ser dilatada en el caso, discriminatoria y sin perspectiva de género, vulnerando garantías judiciales de la víctima.

This report examines the international responsibility of the State of Honduras in the case concerning the death of transgender activist Vicky Hernández, as addressed by the Inter-American Court of Human Rights, in its judgment issued in 2021. Said judgment constituted a historic precedent, as it was the first decision at a regional level that established a State’s responsibility for acts of lethal violence against a transgender person, under a clear gender identity perspective. The purpose of the report is to determine whether, in the context of Hernandez’s death and the subsequent judicial proceedings undertaken to ascertain responsibility, there was a violation of the rights to life and personal integrity, judicial guarantees and judicial protection, as well as recognition of juridical personality, private life and freedom of expression. Likewise, this report seeks to address the underlying discriminatory framework and the prejudice – based violence in the State´s conduct in this case. The report concludes that Hernández’s death occurred within a broader context of generalized violence against transgender persons in Honduras, and that the State incurred in international responsibility by failing to prevent and adequately investigate hee death, thereby violating the aforementioned rights. It further concludes that Vicky Hernández’s death was motivated by prejudice rooted in her gender identity. Additionally, the State’s response to the case was unduly delayed, discriminatory, and lacking a gender perspective, resulting in violations of the victim’s judicial guarantees.
