Abstract
La presente investigación busca describir y analizar el proceso de cambios en el modelo de
relaciones laborales en la industria de la construcción del Perú entre los años 1992 y 2015.
Identificando las decisiones de los actores (trabajadores, empresarios y Estado) en el sector
económico estudiado, que han permitido el tránsito de un modelo restrictivo a un modelo
democrático de relaciones laborales.
Se trata de una investigación aplicada que trabaja con una metodología cualitativa. La misma
que consiste en el análisis de un conjunto de entrevistas semi estructuradas realizadas a
representantes gremiales de los trabajadores, de los empresarios y del Estado; así como el
análisis de la información cuantitativa sobre las relaciones laborales y la industria de la
construcción recopilada a través de diferentes bases datos nacionales e internacionales.
El tema de investigación resulta pertinente pues permite disponer de mejores herramientas en
el análisis de las relaciones laborales y en el diseño de las políticas laborales. El establecimiento
de un marco de relaciones laborales más equilibrado es de una importante relevancia social,
pues se consolida la institucionalidad democrática. De esta manera se benefician tanto los
trabajadores como los empresarios.
El resultado de la investigación identifica en el periodo de 1992 y 2015 cuatro “decisiones
estratégicas” tomadas por los actores que permiten establecer la eficacia de la negociación
colectiva por rama. La misma que ha logrado desarrollarse durante once años consecutivos y
resolverse en trato directo; siendo además la base para la elaboración de una “agenda
sectorial” para la industria de la construcción en donde participan empresarios y trabajadores
y tienen al Estado como contraparte, siendo esta una experiencia única en el ámbito de las
relaciones laborales del país.
This research seeks to describe and analyze the process of changes in the model of labor relations in the construction industry of Peru between 1992 and 2015. Identifying the decisions of the actors (workers, employers and the State) in the economic sector studied, which have allowed the transition from a restrictive model to a democratic model of labor relations. It is an applied research that works with a qualitative methodology. Which consist of the analysis of a set of semi-structured interviews made to union representatives of workers, employers and the State; as well as the analysis of quantitative information on labor relations and the construction industry compiled through different national and international data bases. The research topic is relevant because it allows for better tools in the analysis of labor relations and in the design of labor policies. The establishment of a more balanced framework for labor relations is of significant social relevance, since democratic institutions are consolidated. In this way, both workers and employers will be benefited. The result of the research identifies in the period of 1992 and 2015 four "strategic decisions" taken by the actors that allow to establish the effectiveness of collective bargaining by branch. The same that has managed to develop during eleven consecutive years and be resolved in direct contact; being also the basis for the elaboration of a "sectoral agenda" for the construction industry in which entrepreneurs and workers participate and have the State as a counterpart, this being a unique experience in the field of labor relations in the country.
