Resumen
El informe es el resultado del análisis de la Resolución Final Nº 1284-2014/CC1,
pronunciamiento de la Comisión de Protección al Consumidor del Indecopi en
materia de deber de idoneidad en la actividad del sistema bancario. En el caso
materia de análisis, la señora Cecilia Arbe presenta una denuncia contra el
Banco de Crédito del Perú por infracción al deber de idoneidad al no haber
cumplido con adoptar las medidas de seguridad que establece la normativa
sectorial permitiendo que se realice una operación no reconocida en su cuenta
de ahorros.
Por lo tanto, el análisis jurídico se enfoca en responder al problema de cuáles
son las garantías para brindar un servicio idóneo que involucra la protección al
consumidor respecto de operaciones no reconocidas. Para responder a este
planteamiento, los principales instrumentos normativos utilizados son el Código
de Protección y Defensa del Consumidor, el Reglamento de Tarjetas de Crédito
y Débito, y el Reglamento para la Gestión de la Seguridad de la Información y la
Ciberseguridad. En ese sentido, mediante el análisis de los instrumentos
normativos y jurisprudencia vinculada, se concluirá que la normativa sectorial
prevé una protección mayor al consumidor financiero en materia de operaciones
no reconocidas al establecer obligaciones cuyo incumplimiento deriva en
indubitable infracción al deber de idoneidad.
The report is the result of the analysis of the Final Resolution Nº 1284-2014/CC1, pronouncement of the Consumer Protection Commission of Indecopi regarding the duty of suitability in the activity of the banking system. In the case under analysis, Mrs. Cecilia Arbe file a complainant against Banco de Crédito del Perú for breach of the duty of suitability for not having complied with adopting the security measures established by the sectorial regulations, allowing an unrecognized operation to be carried out in her savings account. Therefore, the legal analysis focuses on answering the problem of which are the guarantees to provide a suitable service involving consumer protection in respect of unrecognized operations. To respond to this approach, the main regulatory instruments used are the Code of Consumer Protection and Defense, the Credit and Debit Card Regulation, and the Regulation for the Management of Information Security and Cybersecurity. In this sense, through the analysis of the normative instruments and related jurisprudence, it will be concluded that the sectorial regulations provide a greater protection to the financial consumer in the matter of unrecognized operations by establishing obligations whose noncompliance derives in indubitable infringement to the duty of suitability.
