Informe Jurídico sobre Resolución Final N° 370-2013/CPC del Expediente N° 2715-2012/CPC

Abstract

A lo largo de desarrollo del siguiente informe jurídico se analizará el expediente administrativo en materia de protección al consumidor, el cual refleja la denuncia interpuesta por la señora Carmen María Del Rosario Bejarano Flores contra CONSTRUCTORA E INMOBILIARIA NUEVA ACROPOLIS S.A.C., con el fin de determinar si la denunciada cumplió con todos los requisitos para obtener la Conformidad de Obra del departamento N°301, ubicado en el proyecto inmobiliario de la denunciada, debido a que, como consecuencia, la denunciada entregó un departamento con un área o metraje diferente al indicado en contrato suscrito con la denunciante. Los temas a desarrollar permitirán confirmar que el departamento entregado a la señora Bejarano la Municipalidad de Surquillo no debió otorgarle la Conformidad de Obra; acto seguido, si la medida correctiva estuvo bien aplicada. De esta manera, a lo largo del presente trabajo, se podrá observar y cuestionar el análisis de los temas controvertidos analizados por el órgano resolutivo, siendo importante la revisión e interpretación del marco regulatorio a fin de determinar si el análisis y resolución emitida por la Sala Especializada en Protección al Consumidor estuvieron bien enfocados; sin perjuicio del enfoque en aras de resguardar la protección de los derechos de la denunciante como consumidora.Through the following legal report, the administrative file on consumer protection will be analyzed, which reflects the complaint filed by Mrs. Carmen María Del Rosario Bejarano Flores against CONSTRUCTORA E INMOBILIARIA NUEVA ACROPOLIS S.A.C., it seeks to determine if the defendant complied with all the requirements to obtain the Building Compliance of apartment No. 301, located in the real estate project of the denounced. The issues to be developed will make it possible to confirm that the apartment delivered to Mrs. Bejarano by the Municipality of Surquillo should not have granted her the Building Compliance; immediately afterwards, if the corrective measure was well applied. In this way, throughout this work, it will be possible to observe and question the analysis of the controversial issues analyzed by the resolving body, being important the review and interpretation of the regulatory framework in order to determine if the analysis and resolution issued by the Commission of Consumer Protection, was well focused, without prejudice to the focus in order to safeguard the protection of the rights of the complainant as a consumer.
