Abstract
Esta investigación aborda un problema recurrente en la ejecución de los contratos
públicos: la posibilidad de la Entidad de declarar la nulidad de oficio de las decisiones
adoptadas durante la ejecución contractual. Por ejemplo, una Entidad identifica que
aprobó una ampliación de plazo basada en información falsa o errada que presentó el
contratista. ¿Puede declarar la nulidad de oficio de esa decisión? La normativa no aclara
esta problemática. El OSCE y los árbitros han tenido criterios distintos e incluso
contradictorios para resolver esta problemática. Esta investigación analiza si la Entidad
puede declarar la nulidad de tales decisiones con base a la nulidad de los actos
administrativos o en la aplicación de la Ley del Procedimiento Administrativo General
This investigation addresses a recurring problem in the execution of public contracts: the possibility of the Entity to declare the nullity ex officio of the decisions taken during the contractual execution. For example, an Entity identifies that it approved an extension of term based on false or erroneous information submitted by the contractor. Can you declare the nullity ex officio of that decision? The regulations do not clarify this problem. The OSCE and the arbitrators have had different and even contradictory criteria to solve this problem. This investigation analyzes whether the Entity can declare the nullity of such decisions based on the nullity of the administrative acts or in the application of the General Administrative Procedure Law.
