Resumen
Este trabajo analiza las graves violaciones a los derechos humanos sufridos por
adolescentes recluidos en centros del SENAME en Chile, a partir del paso
presentado a la CorteIDH. Desde un enfoque normativo y crítico, se examinan
tres ejes fundamentales: el derecho a la vida e integridad personal, los derechos
económicos, sociales, culturales y ambientales (DESCA) y las garantías
judiciales. El análisis identifica omisiones estructurales del Estado chileno tales
como la ineficacia de los protocolos frente al incendio ocurrido, la ausencia de
condiciones mínimas para la atención médica y la educación, así como fallas en
el acceso a la justicia. Si bien la CorteIDH reconoce adecuadamente la
responsabilidad estatal, se evidencia una oportunidad perdida para desarrollar
con mayor profundidad el enfoque de género. En el plano de los DESCA, se
destaca la justiciabilidad del artículo 26 de la CADH, aunque persiste una
aplicación limitada en derechos como la recreación. Entonces, el fallo representa
un avance significativo, pero a la vez, un llamado a los estados de la región a
asumir compromisos estructurales y garantizar los derechos de la niñez privada
de libertad.
This paper analyzes the serious human rights violations suffered by adolescents detained in SENAME centers in Chile, based on the contentious case at the Inter- American Court of Human Rights. Through a normative and critical approach, the study addresses three key axes: the right to life and personal integrity, economic, social, cultural and environmental rights, and judicial guarantees. The analysis reveals Chile’s structural omissions, such as the ineffective implementation of emergency protocols during the center fier, the lack of minimum standard in medical and educational services, and barriers to accessing justice. While the Court appropriately recognized the State’s international responsibility, it missed the opportunity to further develop the gender-perspective. In the dimension of economic, social, cultural and environmental rights, the paper highlights the enforceability of article 26 of the ACHR, although protection remains limited in rights such as recreation. The ruling constitutes an important step forward but also an urgent call por Latin American States to adopt structural reforms and fulfill their role as guarantors of the rights of children and adolescents in detention, with an integral and intersectional approach.
