Abstract
El presente trabajo de investigación pretende analizar las cláusulas abusivas
existentes en la contratación de transporte terrestre, aquellas que limitan el
derecho de los consumidores a transferir o endosar y postergar sus boletos de
viaje, los mismos que se analizaran a lo largo de tres capítulos. En la primera
sección, se analiza el marco constitucional sobre el régimen económico de la
Constitución Política del Perú, la libertad de empresa, derechos de los
consumidores, así como la contratación en masa y su relación con las llamadas
cláusulas abusivas, identificando las particularidades de las mismas en las
relaciones jurídicas de consumo. En la segunda sección, se tratará algunos
aspectos generales y normativos sobre el derecho de los consumidores a
transferir, endosar y postergar sus boletos de viaje en el transporte terrestre. Por
último, en la tercera sección, se hará un breve el análisis de la Resolución Final
N.º 186-2019/CC3, respecto de las cláusulas abusivas en los boletos de viaje,
para ello, se identificarán fundamentos jurisprudenciales relevantes para el
análisis de los aspectos normativos del derecho de los consumidores a transferir
o endosar sus boletos de viaje en el transporte terrestre.
This research paper intends to analyze the abusive clauses existing in the contracting of land transport, those that limit the right of consumers to transfer or endorse and postpone their travel tickets, the same ones that will be analyzed throughout three chapters. In the first section, the constitutional framework on the economic regime of our constitution, business freedom, consumer rights, as well as mass contracting and its relationship with abusive clauses are analyzed, and the particularities of the clauses will be identified. abusive clauses in legal consumer relations. Finally, in the third section, a brief analysis of Final Resolution No. 186-2019/CC3 will be made, regarding abusive clauses in travel tickets, for this, relevant jurisprudential foundations will be identified for the analysis of the regulatory aspects of the right of consumers to transfer or endorse their travel tickets in ground transportation.
