Resumen
Este trabajo analizará la Resolución 2758-2019/INDECOPI, que resolvió una
denuncia presentada por la Asociación de Consumidores Indignados del Perú
(ACIP), en contra del Restaurante La Rosa Náutica S.A. porque se detectó una
práctica discriminatoria, puesto que, al momento de que una pareja acudía al
establecimiento, con el fin de consumir, se otorgaba cartas con precios a los
hombres (color azul) y cartas sin precios a las mujeres (color amarillo); sin previo
consentimiento ni información del tipo de servicio.
La Sala consideró esta política interna un acto de vulneración al derecho a la
información y el derecho a la igualdad. Debido a esto, mi objetivo principal es
determinar si la resolución presenta deficiencias o cumple adecuadamente con
la aplicación de los principios del derecho administrativo sancionador, en
particular, sobre al principio de razonabilidad, legalidad y tipicidad. Para ello, es
pertinente el uso de doctrina e instrumentos normativos como la Constitución del
Perú, el Código de Protección y Defensa del Consumidor, el TUO y la Ley de
Procedimiento Administrativo General, además de normativa internacional como
el Pacto Internacional de Derechos Civiles y Políticos y la CEDAW.
Como conclusiones, se resalta la importancia del uso integral, y en conjunto, de
los principios del derecho administrativo sancionador, específicamente, del
principio de razonabilidad y la creación de políticas públicas con la finalidad de
garantizar el derecho a la igualdad y no discriminación por medio del doble rol
de INDECOPI, como ente sancionador, pero, a su vez, garante de la protección
de los derechos fundamentales.
This paper will analyze Resolution 2758-2019/INDECOPI, which resolved a complaint filed by the Association of Outraged Consumers of Peru (ACIP) against La Rosa Náutica S.A. Restaurant. The complaint was found to contain a discriminatory practice. When a couple visited the establishment to consume, menus with prices (blue) were given to men and menus without prices to women (yellow), without prior consent or information about the type of service. The Court considered this internal policy to be a violation of the right to information and the right to equality. Therefore, my main objective is to determine whether the resolution is deficient or adequately complies with the application of the principles of administrative sanctioning law, particularly the principles of reasonableness, legality, and criminality. To this end, it is pertinent to use legal doctrine and regulatory instruments such as the Peruvian Constitution, the Consumer Protection and Defense Code, the Constitutional Court's Constitution, and the General Administrative Procedure Law, in addition to international regulations such as the International Covenant on Civil and Political Rights and the CEDAW. In conclusion, the importance of the comprehensive and joint use of the principles of administrative sanctioning law is highlighted, specifically the principle of reasonableness and the creation of public policies aimed at guaranteeing the right to equality and non-discrimination through INDECOPI's dual role as a sanctioning body and, at the same time, guarantor of the protection of fundamental rights.
