Resumen
La Sentencia recaída en el Expediente N° 03487-2019-PA/TC se circunscribe al despido
por retiro de confianza aplicado por la Red Asistencial Sabogal EsSalud contra la señora
Flor Vásquez Canales. La demandante señala que, de forma previa al ejercicio de un
cargo de confianza, ocupó un cargo ordinario, con lo cual le corresponde el retorno a su
cargo primigenio. Sin embargo, el Tribunal Constitucional no reconoce la existencia del
puesto primigenio ordinario, entendiéndola como una trabajadora de confianza
exclusiva, con lo cual no le corresponde la reposición ni indemnización ante el retiro de
la confianza. Finalmente, adiciona un criterio a su interpretación, señalando que para
que un trabajador de confianza mixta retorne a su puesto de trabajo originario, es
necesario que haya superado el periodo de prueba en dicho puesto.
En ese sentido, el reconocimiento y validez de una relación laboral primigenia, las
implicancias de asumir cargos de confianza (exclusiva y mixta) y el sentido del periodo
de prueba en la relación laboral, resultan imprescindibles para entender el tratamiento y
consecuencias que suponen en nuestro ordenamiento jurídico. De esta manera, un
análisis doctrinario y jurisprudencial resulta fundamental para advertir el actual
cuestionamiento de estas figuras y tutelar adecuadamente los derechos laborales,
desde una perspectiva protectora tal y como lo concibe el Derecho del Trabajo.
The Judgment in Case No. 03487-2019-PA/TC is limited to the dismissal due to withdrawal of trust applied by the Red Asistencial Sabogal EsSalud against Mrs. Flor Vásquez Canales. The plaintiff states that, prior to the exercise of a position of trust, she held an ordinary position, so she is entitled to return to her original position. However, the Constitutional Court does not recognize the existence of the original ordinary labor relationship, understanding her as a worker of exclusive trust, which means that she is not entitled to reinstatement or compensation in the event of withdrawal of trust. Finally, it adds a criterion to its interpretation, stating that in order for a worker of mixed trust to return to her original position, it is necessary that she has passed the probationary period in such position. In this sense, the recognition and validity of an original employment relationship, the implications of assuming positions of trust (exclusive and mixed) and the meaning of the trial period in the employment relationship are essential to understand the treatment and consequences that they entail in our legal system. In this way, a doctrinal and jurisprudential analysis is essential in order to notice the current questioning of these figures and to adequately protect labor rights, from a protective perspective as conceived by Labor Law.
