El internamiento involuntario de personas con discapacidad mental en el ordenamiento jurídico peruano: STC 01833-2019-HC/TC

Abstract
Este informe es un análisis de la Sentencia del Pleno del Tribunal Constitucional recaída
en el expediente 01833-2019-HC que declara fundada la demanda de habeas corpus y
resuelve cesar la privación de libertad de una persona con discapacidad mental. Este
informe se realiza a la luz de la Convención sobre los Derechos de la Personas con
Discapacidad del Sistema Universal de Derechos Humanos, que servirá de guía del
presente trabajo, así como de las leyes internas sustantivas nacionales que estuvieron
vigentes durante su internamiento (2017-2018) y el Código Procesal Constitucional del
año 2004. Se concluye que hubo vulneraciones a sus derechos e involucró la resistencia
de un paradigma que anulaba la capacidad jurídica de las personas con discapacidad en
centros psiquiátricos. La importancia de este informe radica en el reconocimiento de
derechos de las personas con discapacidad.
This report is an exam of the sentence of the Constitutional Court 01833-2019-HC that declares the habeas corpus claim founded and resolves to cease the deprivation of liberty of a person with mental disabilities. This report is based in the Convention on the Rights of Persons with Disabilities of the Universal Human Rights System, which will serve as a guide for this work, as well as the national substantive internal laws that were in force during the 2017-2018 period. and the previous Constitutional Procedure Code of 2004. It is concluded that there were fundamental rights violations that involved a change in the paradigm that persisted in the legal system and in justice operators. Its importance lies in the recognition of the rights of people with disabilities.
