Informe jurídico sobre la Resolución 2493-2024/SPCINDECOPI

Abstract

El presente Informe analiza la Resolución No. 2493-2024/SPC-INDECOPI, mediante la cual la Sala Especializada de Protección al Consumidor declaró infundada la denuncia por discriminación interpuesta por Williams Zea Sulca contra Delosi S.A. (KFC). Adicionalmente, la Sala ordenó la imputación por infracción al deber de idoneidad respecto de los hechos que la Secretaría Técnica de la Comisión de Protección al Consumidor omitió evaluar en el procedimiento inicial. El caso se originó cuando el denunciante, trabajador de construcción, acudió a un local de KFC en Magdalena del Mar donde el personal de seguridad cuestionó su ingreso, presuntamente insinuando que solo pretendía usar los servicios higiénicos sin consumir. La situación escaló hasta un altercado físico que resultó en daños a su teléfono móvil. El análisis se centra en la interpretación del artículo 38 del Código de Protección y Defensa del Consumidor, criticando la equiparación jurisprudencial entre discriminación y trato diferenciado ilícito establecida por la Resolución No. 2025- 2019/SPC-INDECOPI. La diferenciación conceptual entre ambas figuras es esencial para garantizar tutela efectiva: la discriminación debe exigir acreditar motivos prohibidos, mientras que el trato diferenciado ilícito debe centrarse en diferencias no justificadas objetivamente que afecten materialmente el acceso o goce del servicio. Se concluye que en este caso no se configuró ni discriminación ni trato diferenciado ilícito, sino únicamente una infracción por idoneidad. El cuestionamiento del personal de seguridad al señor Zea constituyó una infracción al deber de idoneidad por defraudar las expectativas razonables de un consumidor potencial, configurar una extralimitación de funciones del personal de seguridad y culminar en agresión física con daño a la propiedad del consumidor.

This Report analyzes Resolution No. 2493-2024/SPC-INDECOPI, through which the Specialized Consumer Protection Chamber declared unfounded the discrimination complaint filed by Williams Zea Sulca against Delosi S.A. (KFC). Additionally, the Chamber ordered the imputation for violation of the duty of suitability regarding the facts that the Technical Secretariat of the Consumer Protection Commission failed to evaluate in the initial proceeding. The case originated when the complainant, a construction worker, went to a KFC establishment in Magdalena del Mar where security personnel questioned his entry, allegedly insinuating that he only intended to use the restroom facilities without making a purchase. The situation escalated into a physical altercation that resulted in damage to his mobile phone. The analysis focuses on the interpretation of Article 38 of the Consumer Protection and Defense Code, criticizing the jurisprudential equation between discrimination and illicit differential treatment established by Resolution No. 2025- 2019/SPC-INDECOPI. The conceptual differentiation between both figures is essential to guarantee effective protection: discrimination must require proving prohibited motives, while illicit differential treatment must focus on objectively unjustified differences that materially affect access to or enjoyment of the service. It is concluded that in this case neither discrimination nor illicit differential treatment was established, but only a violation of suitability. The questioning by security personnel of Mr. Zea constituted a violation of the duty of suitability by frustrating the reasonable expectations of a potential consumer, constituting an overstepping of security personnel functions, and culminating in physical aggression with damage to the consumer's property.
