Resumen
La intermediación laboral se configura como una modalidad de contratación que
puede traer consigo beneficios tales como el incremento de productividad y mejor
capacidad de respuesta frente a los clientes, sin embargo, también representa
desafíos en cuanto al manejo y satisfacción del personal. En este sentido, se
consideró pertinente desarrollar la presente investigación y analizar con detalles la
aplicación de esta figura jurídica en el campo laboral, a fin de determinar el impacto
que tiene la desnaturalización de este tipo de contrataciones a la luz de la normativa
que se encuentra vigente, ello con el objeto de proponer soluciones que conlleven a
la protección de los derechos laborales de los trabajadores destacados.
Para el cumplimiento de los objetivos, se advierte que este estudio se presenta como
una investigación con revisión teórica y análisis de datos que fueron recopilados
mediante instrumentos aplicados a nueve (9) expertos en la materia laboral, con lo
cual permitió realizar comparaciones con estudios previos y realizar las
interpretaciones correspondientes. En vista de ello, el tipo de investigación utilizada
fue básica o pura, con un enfoque netamente cualitativo y diseño fenomenológico.
Así, se concluyó que la intermediación laboral surge como respuesta a las
necesidades de la sociedad y su uso correcto genera beneficios para todas las partes
involucradas, sin embargo, cuando se altera su naturaleza, las consecuencias son
asumidas por los trabajadores, pues incide directamente en la percepción de sus
beneficios laborales. De allí, que se sugiera se analice la posibilidad de establecer
acciones positivas ya que las punitivas no han surtido el efecto pretendido.
Labor intermediation is configured as a hiring modality that can bring benefits such as increased productivity and better responsiveness to customers; however, it also represents challenges in terms of personnel management and satisfaction. In this sense, it was considered pertinent to develop this research and analyze in detail the application of this legal figure in the labor field, in order to determine the impact of the denaturalization of this type of contracting in the light of the regulations in force, with the purpose of proposing solutions that lead to the protection of the labor rights of outstanding workers. For the fulfillment of the objectives, it is noted that this study is presented as research with a theoretical review and analysis of data that were collected through instruments applied to nine (9) experts in labor matters, which allowed comparisons with previous studies and the corresponding interpretations. In view of this, the type of research used was basic or pure, with a purely qualitative approach and phenomenological design. Thus, it was concluded that labor intermediation arises as a response to the needs of society and its correct use generates benefits for all parties involved. However, when its nature is altered, the consequences are assumed by the workers, since it directly affects the perception of their labor benefits. Hence, it is suggested that the possibility of establishing positive actions be analyzed, since punitive actions have not had the intended effect
