Resumen
El presente informe jurídico analiza la sentencia emitida por la Corte
Interamericana de Derechos Humanos en torno al caso Guachalá Chimbó vs.
Ecuador bajo una perspectiva crítica a través de la articulación de estándares e
instrumentos internacionales tales como la Convención sobre los Derechos de
las Personas con Discapacidad, el Pacto Internacional de Derechos Civiles y
Políticos, la Convención Internacional sobre la Protección de Todas las Personas
contra las Desapariciones Forzadas y la Convención Interamericana sobre
Desaparición Forzada de Personas, así como criterios desarrollados en otros
tribunales regionales y otras herramientas jurídicas. En ese sentido, en primer
lugar, se determinará que sí existió una privación ilegítima de la libertad personal
de Luis Eduardo Guachalá Chimbó en el marco de un contexto médico al
haberse fundado su institucionalización en una discriminación a razón de su
discapacidad y no por la situación de emergencia en la que se habría visto inserta
la víctima. En segundo lugar, se argumentará que los hechos ocurridos en torno
a su desaparición sí pueden ser calificados como desaparición forzada al confluir
los elementos de privación de libertad en un centro psiquiátrico, la custodia
estatal y la negativa sistemática del Estado a informar sobre el paradero de la
víctima. Todo ello, finalmente, tendrá por objetivo concluir que el Estado
ecuatoriano es responsable internacionalmente por tales hechos en perjuicio de
Luis Eduardo Guachalá Chimbó y, a su vez, que la sentencia de la Corte aún
conserva elementos ambiguos y/o problemáticos al analizar los mismos
problemas jurídicos.
This legal report analyzes the judgment issued by the Inter-American Court of Human Rights in the case of Guachalá Chimbó vs. Ecuador from a critical perspective, drawing on international standards and instruments such as the Convention on the Rights of Persons with Disabilities, the International Covenant on Civil and Political Rights, the International Convention on the Protection of All Persons from Enforced Disappearance, and the Inter-American Convention on Forced Disappearance of Persons, as well as criteria developed by other regional courts and other legal instruments. In this regard, first, it will be determined that Luis Eduardo Guachalá Chimbó's personal liberty was unlawfully deprived within a medical context, as his institutionalization was based on discrimination based on his disability and not on the emergency situation in which he was placed. Secondly, it will be argued that the events surrounding his disappearance can indeed be classified as enforced disappearance, given the combined elements of deprivation of liberty in a psychiatric facility, state custody, and the State's systematic refusal to provide information on the victim's whereabouts. Ultimately, the Court will conclude that the Ecuadorian State is internationally responsible for these events to the detriment of Luis Eduardo Guachalá Chimbó and, in turn, that the Court's judgment still contains ambiguous and/or problematic elements when analyzing these same legal issues.
