Resumen
El presente informe jurídico analiza el marco normativo que garantiza el derecho
a una educación inclusiva de calidad para las personas con discapacidad en el
Perú, en especial para los niños con el Trastorno del Espectro Autista,
enfatizando el cumplimiento de normas internacionales, constitucionales y
sectoriales. Se destaca la obligación de las instituciones educativas de realizar
adaptaciones en el servicio educativo que permitan el acceso, permanencia y
desarrollo pleno de estudiantes con discapacidad, sin generar costos adicionales
para los estudiantes con el Trastorno del Espectro Autista, conforme a la Ley
General de la Educación y la Ley General de la Persona con Discapacidad.
Asimismo, se aborda la importancia de la no discriminación en la provisión del
servicio educativo, incluido en el Código de Protección al Consumidor, y la
idoneidad del servicio educativo. Finalmente se hace una crítica al criterio de
discriminación utilizado por el INDECOPI, el cual generaría una situación de
indefensión a las víctimas de discriminación.
This legal report analyzes the regulatory framework that guarantees the right to quality inclusive education for people with disabilities in Perú, with a particular focus on children with Autism Spectrum Disorder. It emphasizes compliance with international, constitucional, and sectoral regulation. The report highlights the obligation of educational institutions to make adaptations in the educational service that enable access, retention, and full development of students with disabilities, without generating additional costs for students with Autism Spectrum Disorder in accordance with the General Education Law and the Genereal law on Persons with Disabilities. Furthermore, it addresses the importante of non-discrimination in the provision of educational services, as included in the Consumer Protection Code, and the adequacy of the educational service. Finally, the report critiques the discrimination criteria used by INDECOPI, which could create a situation of defenselessness for victims of discrimination.
