Abstract

El caso WT/DS457/AB/R: Perú – Derecho adicional sobre las importaciones de determinados productos agropecuarios, es un caso sumamente importante en el marco de la Organización Mundial del Comercio (OMC), esto debido a que hay una discrepancia entre los principios multilaterales establecidos y las políticas bilaterales. De esta manera, Guatemala impugna la aplicación del Sistema de Franja de Precios (SFP) realizada por el Perú, el cual está establecido en un Tratado de Libre Comercio que no se encuentra en vigor aún entre los dos Estados. Así, Guatemala indica que este mecanismo constituye un gravamen incompatible con ciertas normas del Acuerdo de Agricultura y el GATT de 1994. Por su parte, el Perú defiende la aplicación del SFP porque indicó que es una medida legítima y cuestionó el actuar de buena fe de Guatemala por haber recurrido al Órgano de Solución de Diferencias (OSD) habiendo sido partícipe de la negociación de la inclusión del SFP en el TLC. Este caso expone las tensiones entre la interpretación del principio de buena fe bajo las normas generales del Derecho Internacional Público y el criterio del Órgano de Apelación de la OMC. A través del análisis realizado se pretende reafirmar la compatibilidad entre las normas internacionales y su importancia para poder entender las situaciones particulares relacionadas al comportamiento de los Estados. A la vez, se busca destacar la obligación de los Estados de actuar con coherencia y transparencia en la relación comercial con los demás.

The case WT/DS457/AB/R: Peru – Additional Duty on Imports of Certain Agricultural Products is a highly significant dispute within the framework of the World Trade Organization (WTO), as it highlights a conflict between the multilateral principles established by the WTO and bilateral trade policies. In this case, Guatemala challenges Peru’s application of the Price Band System (PBS), which was included in a Free Trade Agreement (FTA) that has not yet entered into force between the two States. Guatemala argues that this mechanism constitutes a charge incompatible with certain provisions of the Agreement on Agriculture and the 1994 GATT. For its part, Peru defends the PBS as a legitimate measure and questions Guatemala’s good faith in resorting to the WTO Dispute Settlement Body (DSB), considering that Guatemala participated in negotiating the inclusion of the PBS in the FTA. This case exposes the tensions between the interpretation of the principle of good faith under general norms of Public International Law and the approach taken by the WTO Appellate Body. Through this analysis, the aim is to reaffirm the compatibility of international norms and their importance in understanding specific situations related to State behavior. At the same time, it seeks to highlight the obligation of States to act with consistency and transparency in commercial relationship swith other States.
