Resumen
El caso analizado se centra en la campaña publicitaria de Wi-Net, difundida en el año
2022, que fue denunciada por Telefónica y América Móvil por presuntos actos de
competencia desleal en modalidades de engaño, denigración, comparación indebida y
violación de los Principios de Legalidad y Adecuación Social. La publicidad contenía
elementos que aludían indirectamente a sus competidores, usando frases como “ya
nos metieron la rata” y mostrando problemas en servicios rivales.
La Comisión y la Sala Especializada en Defensa de la Competencia de INDECOPI
declararon infundadas las denuncias, argumentando que no existía una alusión
inequívoca a Telefónica o América Móvil, y que los mensajes publicitarios estaban
respaldados por pruebas, especialmente en cuanto al reconocimiento de Wi-Net por su
velocidad en ciertos periodos. Además, se consideró que la publicidad no estaba
dirigida específicamente a menores ni promovía estereotipos de género o violencia.
Sin embargo, el análisis crítico del informe señala discrepancias, especialmente en la
interpretación del mensaje sobre la supuesta infalibilidad del servicio de Wi-Net y en la
evaluación de la alusión inequívoca en un mercado oligopólico donde pocos
competidores dominan el sector. Se concluye que la campaña sí contenía alusión
indirecta a sus competidores y que las afirmaciones comparativas no cumplieron con
la excepción de veracidad, por lo que debió sancionarse por comparación indebida.
The analyzed case focuses on the advertising campaign of Wi-Net, disseminated in 2022, which was denounced by Telefónica and América Móvil for alleged acts of unfair competition in modalities of deception, denigration, undue comparison and violation of the Principles of Legality and Social Adequacy. The advertising contained elements that indirectly alluded to its competitors, using phrases such as “ya nos metieron la rata” and showing problems in rival services. The Commission and the Specialized Chamber for the Defense of Competition of INDECOPI declared the complaints unfounded, arguing that there was no unequivocal allusion to Telefónica or América Móvil, and that the advertising messages were supported by evidence, especially regarding to the recognition of Wi-Net for its speed in certain periods. In addition, considered that the advertising was not specifically aimed at minors, nor did promote gender stereotypes or violence. However, the critical analysis of the report points out discrepancies, especially in the interpretation of the message about the alleged infallibility of the Wi-Net service and in the assessment of the unambiguous allusion in an oligopolistic market where few competitors dominate the sector. It is concluded that the campaign did contain indirect allusion to its competitors and that the comparative statements did not comply with the exception of truthfulness, so it should have been sanctioned for undue comparison.
