Resumen
El presente informe jurídico versa sobre la vulneración al derecho a la educación
del menor de edad con iniciales P.N.F.F., luego de que la Institución Educativa
Innova Schools decidiera no renovar la matrícula escolar para el año 2020 por
conducta discriminatoria perpetrada por la madre hacia el personal de la
institución. Ante ello, por medio de recurso de agravio constitucional, el Tribunal
Constitucional resuelve el caso, declarándola infundada. En efecto, consideró
que no existía vulneración al derecho a la educación en virtud de que el
comportamiento de la madre sería contrario al reglamento y ordenamiento
jurídico, situación que se ve acrecentada por el comportamiento disruptivo del
menor estudiante. Ante ello, se considera que la decisión del Tribunal no fue
adecuada en virtud de que la medida de no renovación vulnera el principio de
responsabilidad personal y proscripción de la responsabilidad por hecho ajeno;
así como, no se condice con el interés superior del Niño. En efecto, tales
supuestos se sustentan en la importancia de garantizar el acceso y continuidad
de la educación del menor de edad. Adicionalmente, se considera necesario a
analizar si la sustracción de la materia invocada por el Tribunal resulta adecuada,
ya que se la madre del menor termino retirando a su hijo de la Institución
educativa Innova Schools.
This legal report addresses the violation of the right to education of a minor with the initials P.N.F.F., after the Innova Schools Educational Institution decided not to renew his school enrollment for 2020 due to discriminatory conduct perpetrated by the mother toward the institution's staff. In response, the Constitutional Court resolved the case through an appeal for protection, declaring it unfounded. It found that there was no violation of the right to education because the mother's conduct was contrary to regulations and the legal system, a situation aggravated by the disruptive behavior of the minor student. Therefore, the Court's decision is considered inadmissible because the non-renewal measure violates the principle of personal responsibility and the prohibition of liability for the acts of others; and that it is not in accordance with the best interests of the child. Indeed, such presumptions are based on the importance of guaranteeing access to and continuity of the minor's education. Furthermore, it is considered necessary to analyze whether the Court should dismiss the matter, given that the minor's mother ultimately withdrew her son from Innova Schools.
