Abstract
Es importante tomar conocimiento respecto de las obligaciones y
responsabilidades que debe emplear una persona natural o jurídica cuando
optará por brindar el servicio de estacionamiento vehicular, ya sea como
actividad principal o como actividad accesoria. Esto, debido a que, como
cualquier prestación de servicio, se encontrará regulada por el Código de
Protección y Defensa del Consumidor, que exigirá que se cumpla el principio de
idoneidad. Asimismo, es relevante tomar en cuenta la asimetría informativa en
esta relación de consumo, donde los consumidores optarán por tomar estos
servicios para tener mayor cuidado respecto de los vehículos. Es evidente que,
ante algún defecto encontrado en la prestación de un servicio, es decir, en una
relación de consumo, no siempre tendremos suficientes pruebas materiales, por
lo que la valoración de las pruebas indiciarias debe tomar mayor relevancia y
deben ser analizadas en conjunto por el juzgador. De esta manera, los
consumidores que opten por tomar el servicio de estacionamiento vehicular se
sentirán seguros en donde las medidas reglamentarias se encuentren siendo
cumplidas por los proveedores.
It is important to be aware of the obligations and responsibilities that a natural or legal person must assume when choosing to provide a vehicle parking service, whether as a main or ancillary activity. This is because, like any service provision, it will be regulated by the Consumer Protection and Defense Code, which requires compliance with the principle of suitability. Likewise, it is relevant to take into account the informational asymmetry in this consumer relationship, where consumers will opt to take these services to ensure greater care of their vehicles. It is evident that, in the event of a defect found in the provision of a service, that is, in a consumer relationship, we will not always have sufficient material evidence, so the assessment of circumstantial evidence must take on greater relevance and must be analyzed as a whole by the judge. In this way, consumers who choose to use the vehicle parking service will feel secure knowing that the regulatory measures are being complied with by the providers.
