Informe jurídico sobre el expediente Nº02743-2021-PA/TC

Abstract

El presente informa analiza la decisión del Tribunal Constitucional que declaró infundada la demanda presentada para obtener el reconocimiento en el Perú de un matrimonio celebrado en el extranjero entre personas del mismo sexo. El problema principal se centra en determinar si existe un deber constitucional y convencional que obligue al Estado peruano a reconocer dicho matrimonio. Para ello, se examinan los principios de igualdad, no discriminación, dignidad, así como la relevancia del bloque de constitucionalidad y los estándares del Sistema Interamericano de Derechos Humanos. De los estándares normativos expuestos, cabe mencionar la Constitución Política del Perú, el Código Civil, la Opinión Consultiva 24/17, determinada jurisprudencia interamericana y aportes doctrinarios contemporáneos en cuanto a los derechos LGBTIQ+. En el análisis se sostiene que, si bien el Tribunal Constitucional opera a partir de una lectura tradicional del concepto de institución matrimonial, dicha lectura resulta denigrante ante los estándares internacionales que prohíben la discriminación en función de la orientación sexual. A su vez, se sostiene que la negativa a otorgar el reconocimiento jurídico acarrea un trato desigual injustificado y que, por ende, existe un deber constitucional y convencional de garantizar el equivalente reconocimiento del derecho entre aquellos que integran una pareja del mismo sexo.

This report analyzes the decision of the Constitutional Court that declared unfounded the lawsuit filed to obtain recognition in Peru of a marriage between two men celebrated abroad. The main issue centers on determining whether there is a constitutional and conventional duty that obliges the Peruvian State to recognize such a marriage. To this end, the principles of equality, non-discrimination, and dignity are examined, as well as the relevance of constitutionality and the standards of the Inter-American Human Rights System. Among the regulatory standards outlined, it is worth mentioning the Political Constitution of Peru, the Civil Code, Advisory Opinion 24/17, certain inter- American jurisprudence, and contemporary doctrinal contributions regarding LGBTIQ+ rights. The analysis argues that, although the Constitutional Court operates on the basis of a traditional interpretation of the concept of marriage, this interpretation is degrading in light of international standards that prohibit discrimination on the basis of sexual orientation. In turn, it argues that the refusal to grant legal recognition leads to unjustified unequal treatment and that, therefore, there is a constitutional and conventional duty to guarantee equivalent recognition of the right among those who form a same-sex couple.
