Abstract
La Resolución N° 11 del Expediente N° 00028-2021-0-1817-SP-CO-02 declara
fundado el recurso de anulación del Laudo del caso arbitral Nº 283 – 2017 – CCL.
Ello debido a la existencia de un vínculo de amistad entre el árbitro Beltrán y el
abogado Fernández que genera una duda razonable sobre la imparcialidad e
independencia para resolver la controversia sometida al Tribunal Arbitral del cual
el árbitro Beltrán es parte.
Este informe aborda temas como la naturaleza jurídica del arbitraje, el recurso
de anulación de laudo, el deber de revelación, la imparcialidad e independencia
de los árbitros y la recusación.
Para analizar dichos problemas, emplearé instrumentos normativos como el
Decreto Legislativo N° 1071, el Reglamento de Arbitraje de la Cámara de
Comercio de Lima, el Reglamento de la Cámara de Comercio Internacional, las
Directrices IBA y el Reglamento London Court of International Arbitration.
Asimismo, la jurisprudencia y doctrina correspondiente.
Resolution No. 11 of File No. 00028-2021-0-1817-SP-CO-02 declares the annulment appeal of the Award of arbitration case No. 283 – 2017 – CCL to be founded. This is due to the existence of a friendship between arbitrator Beltran and lawyer Fernandez, which generates a reasonable doubt about the impartiality and independence to resolve the controversy submitted to the Arbitral Tribunal of which arbitrator Beltran is a part. This report addresses issues such as the legal nature of arbitration, the annulment appeal of the award, the duty of disclosure, the impartiality and independence of arbitrators and recusal. To analyze these problems, I will use normative instruments such as Decreto Legislativo N° 1071, IBA Guidelines, Arbitration Regulations of the Lima Chamber of Commerce and the Regulations of the London Court of International Arbitration. Likewise, the corresponding jurisprudence and doctrine.
