Abstract
La corrupción tiende a ser abordada y enmarcada principalmente en torno a sus
manifestaciones más visibles y mediáticas, las cuales suelen consistir en
transacciones económicas de naturaleza ilícita. No obstante, este enfoque
reduccionista soslaya otras manifestaciones igualmente perniciosas del
fenómeno, cuyos impactos diferenciados sobre grupos vulnerables, como las
mujeres, son a menudo ignorados, minimizados o desvinculados del discurso
anticorrupción. A modo ilustrativo, se presentan escenarios en los que la
corrupción se entrelaza con estructuras patriarcales preexistentes, configurando
un sistema en el que los cuerpos y la dignidad de las mujeres se convierten en
"monedas de cambio", incidiendo en la vulneración sistemática de sus derechos.
Ante tal contexto, el presente Informe Jurídico, a partir del análisis de la sentencia
de Apelación N°14-2015/NCPP, tiene como objetivo principal coadyuvar a la
visibilización de las dimensiones de género inherentes al delito de cohecho
pasivo específico que tengan como medio corruptor los favores sexuales, y
subrayar la necesidad de aplicar la perspectiva de género como herramienta
metodológica en el análisis y tratamiento de estos casos. Para ello, el presente
trabajo ha empleado diversos recursos para un análisis adecuado, tales como la
referencia a jurisprudencia y doctrina nacional como comparada. Siendo que,
tras una investigación exhaustiva, se concluyó efectivamente que los jueces de
la Corte Suprema de Justicia no impartieron justicia con perspectiva de género
en el caso analizado.
Corruption tends to be addressed and framed primarily around its most visible and mediatic manifestations, which usually consist of economic transactions of an illicit nature. However, this reductionist approach overlooks other equally pernicious manifestations of the phenomenon, whose differentiated impacts on vulnerable groups, such as women, are often ignored, minimised or dissociated from the anti-corruption discourse. By way of illustration, scenarios are presented in which corruption is intertwined with pre-existing patriarchal structures, configuring a system in which women's bodies and dignity become "bargaining chips", leading to the systematic violation of their rights. In this context, the main objective of this Legal Report, based on the analysis of the Appeal Judgement N°14-2015/NCPP, is to contribute to the visibility of the gender dimensions inherent to the crime of specific passive bribery with sexual favors as a corrupting means, and to underline the need to apply the gender perspective as a methodological tool in the analysis and treatment of these cases. To this end, this paper has employed various resources for an adequate analysis, such as reference to national and comparative jurisprudence and doctrine. After an exhaustive investigation, it was effectively concluded that the judges of the Supreme Court of Justice did not impart justice with a gender perspective in the case analyzed.
