Resumen
La presente tesis aborda la invisibilización de los niños, niñas y adolescentes en la
atención de los casos de violencia en el marco de la Ley N° 30364, con el objetivo
de identificar cuáles son las causas de dicha invisibilización. Se llevó a cabo una
investigación cualitativa, recurriendo a revisiones bibliográficas, análisis de datos
estadísticos, estudio de expedientes judiciales y entrevistas a operadores de justicia.
Los resultados revelan que la invisibilización referida responde a dos causas: una
normativa, referente a la falta de enfoque de niñez en la ley, y, a una cognitiva,
relacionada a la falta de especialización y atención interdisciplinaria de estos casos
por parte de los operadores de justicia.
La investigación tiene implicaciones para la reforma del marco normativo y la mejora
de los procedimientos legales relacionados con la protección de niños, niñas y
adolescentes, y sugiere que es necesario implementar un enfoque de niñez y
promover programas de capacitación especializados para los operadores de justicia.
Este estudio contribuye a la comprensión de las deficiencias en el sistema judicial
en la atención de esta clase de víctimas y a la identificación de áreas críticas para la
mejora de su atención en el marco de la Ley N° 30364. Asimismo, abre la puerta a
futuras investigaciones en la evaluación de la efectividad de nuevas políticas y
capacitaciones en la protección de niños, niñas y adolescentes, así como el impacto
de esto en la reducción de la invisibilización en casos de violencia.
This thesis addresses the invisibility of children and adolescents in the attention of cases of violence within the framework of Law No. 30364, with the aim of identifying the causes of said invisibility. A qualitative investigation was carried out, using bibliographic review, analysis of statistical data, study of judicial files and interviews with justice operators. The results reveal that the aforementioned invisibility responds to two causes: a normative one, referring to the lack of focus on childhood in the law, and a cognitive one, related to the lack of specialization and interdisciplinary attention to these cases by justice operators. The research has implications for the reform of the regulatory framework and the improvement of legal procedures related to the protection of children and adolescents, and suggests that it is necessary to implement a child rights-based approach and promote specialized training programs for justice operators. This study contributes to the understanding of the deficiencies in the judicial system in the care of this type of victims and to the identification of critical areas for the improvement of their care within the framework of Law No. 30364. Likewise, it opens the door to future research into the evaluation of the effectiveness of new policies and training in the protection of children and adolescents, as well as the impact of this on reducing invisibility in cases of violence.
