Abstract

El presente informe jurídico aborda la situación de un niño de 6 años de edad con TDAH de tipo combinado, que en el año 2018 fue matriculado en la Institución Educativa ‘Innova Schools’, sede de Pueblo Libre. Sin embargo, la Institución le negó la matrícula para el siguiente año lectivo, basándose en su RI. Dicha situación vulneró los derechos a la educación inclusiva y no discriminación del niño. En ese sentido, la madre recurrió a las instancias judiciales a fin de solicitar la tutela jurisdiccional efectiva ante la amenaza contra los derechos a la educación, igualdad y no discriminación y, solicita se ordene la renovación de la matrícula para el año lectivo 2019. Sin embargo, tanto el Juzgado, Sala Constitucional y el TC, resolvieron declarar improcedente la demanda, por la supuesta configuración de la sustracción de la materia, toda vez que la madre matriculó al niño en otro colegio. Es por ello que, se buscará responder a la interrogante si la Institución vulneró el derecho a la educación inclusiva del hijo de Teodora Luzmila Gamarra, ante la negativa de renovar la matrícula para el año lectivo de 2019. Tras el análisis realizado, se confirmó que la Institución sí vulneró los derechos a la educación inclusiva y no discriminación, del niño. Ello implica que, las vulneraciones a dichos derechos, obligaban al TC a pronunciarse sobre el fondo de la controversia; además, que el TC debió declarar fundada la demanda, al no configurarse la sustracción de la materia.

This legal report addresses the situation of a 6-year-old boy with combined ADHD who was enrolled in the Pueblo Libre school "Innova Schools" in 2018. However, the school denied him enrollment for the following school year based on his RI. This situation violated the child's rights to inclusive education and non- discrimination. Therefore, the mother appealed to the courts to request effective judicial protection against the threat to his rights to education, equality, and non-discrimination, and to request that his enrollment be renewed for the 2019 school year. However, both the Court, the Constitutional Chamber, and the Constitutional Court ruled to declare the claim inadmissible due to the alleged withdrawal of the subject matter, since the mother enrolled the child in another school. Therefore, we will seek to answer the question of whether the institution violated the right to inclusive education of Teodora Luzmila Gamarra's son by refusing to renew his enrollment for the 2019 school year. After the analysis, it was confirmed that the institution did violate the child's rights to inclusive education and non-discrimination. This implies that the violations of these rights required the Constitutional Court to rule on the merits of the dispute; furthermore, the Constitutional Court should have declared the claim well- founded, as the removal of the subject matter was not established.
