Resumen
El presente caso versa sobre los límites al uso de mecanismos y protocolos de
seguridad por parte de los proveedores de bienes y/o servicios en caso de
intervenciones por presunción de hurto. Al respecto, la Resolución N° 4035
2014/SPC-INDECOPI aborda la experiencia vivenciada por el menor de iniciales
A.G.C.D. hijo de doña Maricela Díaz Díaz (en adelante la señora Díaz) quien
fuese intervenido por personal de seguridad del establecimiento comercial Plaza
Vea (propiedad de Supermercados Peruanos Sociedad Anónima, en adelante
S.P.S.A.) ubicado en el Centro Comercial Real Plaza Chiclayo al activarse el
sensor de seguridad de la puerta cuando disponía a retirarse tras ir a comprar
golosinas a dicho recinto junto a sus hermanas, una de ellas mayor de edad,
además del amigo de esta última.
En ese sentido, el presente informe analizará si los actos llevados a cabo por el
personal de S.P.S.A., que involucraron inspeccionarlo corporalmente a la salida
del local y, al no encontrarse indicios de hurto, llevarlo a un baño vacío donde
posteriormente fue desvestido e interrogado, se encontraron dentro de los límites
del deber de idoneidad del artículo 19 del Código de Protección al Consumidor
o si más bien vulneraron dicha normativa y fueron sancionados apropiadamente.
The present case deals with the limits to the use of security mechanisms and protocols by suppliers of products and/or services in the event of interventions due to presumed theft. In this regard, Resolution N° 4035-2014/SPC-INDECOPI approach the experience lived by the minor with the initials A.G.C.D. son of Mrs. Maricela Díaz Díaz (hereinafter Mrs. Díaz), who was intervened by the security guards of Plaza Vea commercial establishment (owned by Supermercados Peruanos Inc., hereinafter S.P.S.A.) located in Real Plaza Chiclayo Shopping Center when the security sensor of the door was activated just when he was leaving after buying sweets at that place with his sisters, one of them of legal age, and her friend of the last one. In this sense, this report will analyze whether the acts carried out by S.P.S.A. personnel, which involved physically inspecting him upon leaving the premises and, upon finding no signs of theft, taking him to an empty bathroom where he was subsequently undressed and interrogated, are found within the limits of the duty of suitability of article 19 of the Consumer Protection Code or rather if they violated said regulations and were appropriately sanctioned.
