Abstract
La publicidad tiene dos funciones: persuadir e informar, ya que, por un lado, el
agente económico usa la publicidad comercial para convencer a los
consumidores para que contraten o adquieran sus productos o servicios. Por otro
lado, la publicidad comercial también informa, toda vez que muestra las
características, beneficios, etc. de los servicios o productos anunciados.
Es por eso que, a lo largo del análisis del presente documento, nos preguntamos
sobre la importancia de las condiciones de las campañas publicitarias al
momento de interpretarlas. En el caso de la Resolución materia del Informe,
dichas condiciones desvirtuaban el mensaje unificador trasmitido durante la
campaña para los planes Claro Max Internacional, toda vez que por un lado se
informaba sobre un beneficio, pero por otro, en la sección de condiciones, se
restringía en totalidad dicho beneficio.
De este análisis devendrá la interrogante de si, América Móvil cometió actos de
competencia desleal en la modalidad de actos de engaño, al haber desvirtuado
el mensaje trasmitido en la campaña publicitaria, siendo que las características
anunciadas en la campaña, no se ajustaban a la realidad.
Para el desarrollo del Informe y análisis de los problemas planteados, se usó la
normativa aplicable y correspondiente como es la Ley de Represión de
Competencia Desleal (Decreto Legislativo 1044) y jurisprudencia de la Sala
Especializada en Defensa de la Competencia del Indecopi, principalmente

In the case of the Resolution that is the subject of this report, these conditions undermined the unifying message transmitted during the campaign for the Claro Max International plans, since on the one hand a benefit was informed, but on the other one, this benefit was fully restricted in the section of conditions. From this analysis a simple question will arise. This regards whether or not America Móvil had distorted the message transmitted in the advertising campaign. América Móvil would have carried out unfair competition in the form of acts of deception since the characteristics announced in the campaign did not adjust to reality. For the development of this report and analysis of the problems presented, the corresponding regulations such as the Law for the Repression of Unfair Competition (Legislative Decree 1044) and jurisprudence of the Specialized Chamber in Defense of Competition of Indecopi were mainly used.
